"I just think it will be too hard to prove mental 'damage' occurred to all who knew Sora and it would be better to go with what we have and if something gets cut we bring in the right to override Xemnas's statements saying that he cannot be tried for the crimes he did against Organization members. Tell me how you want to word something else but these are the charges as I have them so far."

"I removed the others because the Defense brought up good points and I see no reason to pursue them any further. It is clear that at least for a while the 'attempted' murder of Sora was not something that Marluxia was willing to do, even if he did send Vexen to do so and Larxene took her initiative. He intended to use Sora in a brainwashed state instead and perhaps down the road he intended his murder, but while he was under his control, it doesn't appear that it was his wish. Instead he wanted to use him to take out Xemnas and others that stood in his way."

It is also clear that Marluxia had known Vexen probably could not take the Keyblade wielder and this was a way to get rid of him, by employing Axel to the service of assassinating Vexen, so of course, Vexen was used to get what Marluxia wanted. This is why I altered my stance on it. If Vexen voiced that he wished charges for the Conspiracy to murder him to go through, then we would press that but I don't think we can press it anymore that Sora was intended to be murdered at the time of this dubious plot. We could still but there are points the Defense brought up that would make it so arrangements can be done. After all, you realize we are just doing settlement now and Marluxia is not being asked to even take the stand."

I think it is time for us to just now let the Judge settle it so we can move on and get to the next Organization member. If we hold up things much longer, it will turn out messier."

Axel found himself dosing off as Marluxia's trial proceeded. He jumped back into consciousness as the hand and elbow he was resting on the wooden railing to support his chin had slid off. It was utterly and completely a stupid move, if anyone had managed to catch it from across the room, for he obviously stumbled whence he lost his ground from under his elbow and came crashing down to the floor, only to hit his head on the railing, the only thing that had managed to stop his fall to the ground and keep him in his chair.
“OW!” He grumbled. Hope no one had seen that, he thought. Rubbing his head, and attempting to look casual, he sat back up on his chair. He really needed a recess time, to get a good strong cup of caffeine... er, coffee. He rubbed his head as his eyes peered at the court, nothing seemed to have changed, the Blah-Blah argument was still going on about Flower Boy, and he grunted at that. He'd wished that it would already be over when he would awaken, guess not then, and apparently he hadn't been away for too long either. Damn. His eyes shifted to Marluxia who was holding a piece of paper, and was looking surprised and. . . distressed? Ehh, like he cared. Whatever. Just give him the death sentence already, he dryly thought to himself, he never liked that man anyway. It was his fault that he ended committing murder in that castle. . .

 

"I will press the assault and murder charges on my own. I have countered the defense's points.

Vexen was sent against Sora to kill him, orders of Murluxia. This is fact.
Sora went to the top floor, Murluxia threatened Namine. Repliku charged in to save Namine, weapon drawn. Murluxia drew his weapon, then Sora drew the keyblade. Murluxia altered Sora's (possibly Repliku's) memories to care about Namine, and to defend her against 'the bad guys' he planned to lead Sora to him.
Murluxia's clone looses.
Sora enters the room. To do what is unknown. He may have been going to try to convince him to get friends. Sora got attacked by wind, then was assaulted by a machine before drawing the keyblade.

Murluxia threatened to "scatter his heart to the empty winds". He could rebuild a broken heart, but the pieces there would be all over the winds.

Xelax then turned to the Judge, he wondered if a verdict would ever be reached.

Xelax also realized he and Janexna put up a pretty solid defense for Marluxia. And was quite shocked by how many charges rolled off already. He could only wonder what Kristoph would think...

 

Harvey gave a nod. "Well then I think we can let the Judge decide and put those in then as well as your side. He will be the one to say whether guilty or not, and I think we can just go ahead and place it all towards him now or you can continue to debate with the Defense but I think the charges I have are done here. Are you ready to present them to the Judge now or want to discuss more?"

Sora blinked over as Axel suddenly seemed to spring to life and then collapse out of his chair, hitting his head and all. He winced noticeably. "..ow..are you okay, Axel?"

Riku turned and looked over at the calamity of Axel as he tried to clamber back into his seat and look like nothing had happened. "This is that boring, huh?" was all he could think to say and yet make light of it. He knew Axel and any Nobody really was pretty durable or he'd have gone over to check on him.

Repliku turned and watched Axel make a fool of himself because he had zoned out and pondered if there was such a thing as Nobody ADD. He didn't much like Axel but that kind of looked painful there. He then turned back to look at Sora and chuckled at him wincing and then yawned slightly. He would have hated to admit that he was starting before to fall to sleep before Axel made all that noise and woke him up...because he might have fallen out of his seat if he had. It was about time Axel did something useful other than killing people.

 

Xelax was suprised that they dissagreed on a point. "Mr. 150, didn't I already prove that Sora entered the room with the intent to kill? And therefore, Marluxia's attempts to defend himself, which failed need I remind you, do not count as attempted murder or assult."

Xelax let out a sigh. "Lets face it, the worse thing Marluxia was was a manipulator, and manipulation is not a crime in itself."

A mysterious man in his twenties, looked on at the court case. "Well... the prosecution and the defense are both doing a rather impressive job. But they are each telling one side of the story... and not trying to seek out the truth. If needs be, I will step up after the case to solve all the mystery's on my own, until now, I should probably just sit and wait to see what happens.

OOC: Because I'm the Stewart of Gondor and I can do as I damn well please! Oh... and he is going to follow the rules I set out for you, "Not interfearing with the case." Even though his thoughts do imply otherwise.

 

Okey then. . . apparently his stupidity was noticed across the room, he did, after all, made quite a loud yelp about it, and there were several pairs of eyes peering at him with huge grins of their faces. Perfect. Well, it was quite painful, and it was hard not to make any noise at all. Well, at least it was just a yelp and not any other colorful statements he usually made. Sighing, he shifted his eyes away from Marluxia [Damn him!], and he leaned back on his chair still rubbing his head. That little stumble actually hurt him more than he anticipated and he groaned in his seat, rubbing his temples, his deep green eyes looking back up as he heard a concerned voice inquiring about his pain, and the familiar voice belonging to the Keybalde master, Sora. “Er. . . Yeah. I think.â€
Axel eyes even caught the sad stares of Riku and his twin, er, no, the replica– , no, no, Repliku. What Riku had said was in fact true, but that really was not the case. He just, didn't want the court to linger on these cases like a bunch of leeches, that's all. All he wanted to do now was just go to the Twilight Tower with his little blond, Keyblade wielder buddy and enjoy a Sea-Salt Ice-Cream, just like old times.
“Ehh, it'll linger. . . my attention.†He shrugged. â€I just need a bit more action from this place, like setting some files on fire or something. That should do it.â€

Yep, that definitely would've done it.

She is a special Nobody and the only Darkness there was that of the Dark Keyblade used. If she felt loneliness and intimidated, who are you to say she did not? You cannot prove otherwise by just using what Yen Sid had said because she is a unique Nobody that doesn't fit the profiles, said by Ansem the Wise who knew more of them by being out there amidst it all."

"Again, what I showed proves Marluxia sealed the door to the castle AND he gave the group suspicions that Riku and the King were inside. Also, he used Namine to make them feel emotionally as though the King and Riku were there. Riku and the King were NOT there before Sora was and this is stated that it was Sora and Riku's connection that brought him there when Sora was already present. He lured them there, trapped them there and then gave them incentive to play his mad little game that was to attempt to make Sora a puppet to his whim. I don't see how it can be any clearer."

Let's also remind ourselves that this also involved Roxas, who had no choice but to rejoin with Sora to get his memories back. Xemnas obviously had other plans for Roxas who was in fact an Organization member. This is mental damage and mental damage is not always permanent. It is long lasting and I consider the trauma they went through being stuck there, desperate to find their friends, led into a conspiracy where their memories were stolen from them, being used, and then having to wait an entire year for their memories of their former lives to be returned cause for Mental Damage as a charge."

Sora snickered. Yeah, that was Axel. It would be amusing to see files burning. Then they could leave and go off and play and eat ice cream or something. The ultimate recess. Sora of course did not really notice the guy walking in. His attention was on Axel and other things and his perception sucked and had to of course be played out here. =:)

Riku chuckled softly at Axel's comment. "I would say I'm all for that but you'd probably take me serious and do it and then we'd both be screwed." Riku glanced back at the new fellow that entered and frowned. He hoped this was not going to turn out to be something bad. It usually was though when someone came in with a peculiar aura about him.

Repliku stared at the new guy who had come in, curious as to who he was. He then turned away realizing it's just another hooded mystery guy. What was with all the attempts on being spooky and mysterious for? Didn't anyone show their faces anymore? This being said...when did Repliku honestly meet people other than Sora and his friends that did not disguise themselves? Today was a weird day.

 

Following everyone else's eyes, Axel too looked to the direction to where everyone was facing, and it was yet another guy in an organization coat. Oh goody, another one. Has their trench coat suddenly become the ultimate fashion statement? Whatever. Axel ignored the man and his little comment and turned back to what he was doing before. . . which was. . . oh yes, talking to Sora and Riku about setting things on fire.
"Maybe I can light something on fire discreetly." He leaned forward and whispered the second bit, not that it was any less louder. "No one has to know."

 

Kairi saw the man known as the "Stewart of Gondor" walk in. No wait. She rubbed her face vigorously. This might have been one of the people that she called earlier as a contingency plan. But he didn't fit the description...

She realized that this man must be a third party outside of these proceedings. He didn't walk the path of light, dark, dawn, twilight or nothingness. Hopefully, he wasn't just another mysterious person hell-bent in frustrating people about his identity. For all she knew, this guy could've been Xelax's twin brother. Kairi glanced over at the empty seat next to Roxas. What was taking Naminé so long?

The bailiff noticed some newbie attempt to walk in discreetly, but failed miserably. He wondered if he should do his job and dropkick the idiot out of the courtroom. After all, he could've been a terrorist for all he knew. After a few seconds, he decided against it. Not like the ****** was harming anyone anyways. If he decided to pull something, though...

Zack absent-mindedly tightened his gloves. He had a lot of pent up frustration he wanted to DESPERATELY let out, but he was still on the clock. It was best to just let things lie for now.

That's when he noticed that the judge seemed to have fallen asleep on them. The prosecution and the defense were more than ready to hear his thoughts about the charges. But...

He considered bounding up to the judge's seat and slamming the gavel down to wake him up, but instead contented himself with clearing his throat loudly, hoping to revive the snoozing judge.

 

"Discreetly works for me. Can't go wrong with discreet flame." Riku smirked and leaned back in his chair. He glanced at Kairi and then at Namine's empty seat. That girl must be really powdering her nose and every part of her body for how long it was taking her. "Sooo...did Namine run out for pizza or something?"

Riku then wondered if Xemnas knew all of these new people wearing Org cloaks. Suddenly Riku wished he had not tossed his off and had kept it because he could have left and came back all mysterious too just to mess with people. Yeah, he was kind of getting bored or something.

Sora snickered and gave a shrug. "How discreet can fire be?" There hardly was ever anything that discreet about Axel except for the fact that people underestimated his cleverness.

Mewtwo sighed.

"Coercion of Repliku is there because Murluxia was placed in charge of castle Oblivion and the occupants. This means Repliku was also his responsibility. He knew what happened to Repliku, so he must have known about the permission Vexen gave. It was his duty as a guardian to step in and protect Repliku."

Mewrtwo paused, then continued.
"Child abuse Namine is due to his imprisoning of her in a room, on a chair, while exposing her to taunting. Signs also point to Namine having emotions, as I have already said. Check it in the court records.

Imprisoning Sora, Donald, Goofy and Jiminy... This was not done by them. It was Murluxia who closed the door. He also imprisoned them through their emotions, and memories. Like drugging someone so they are unable to leave.

The Conspiracy to Control Sora mentally was mentioned continuously by all the org members. Axel said "so you have become his puppet after all" and even Murluxia said at the end that he would have the keyblade bearer as his slave.

Mental Damage to Sora, Donald, Goofy, Jiminy, Repliku and everyone Sora knows was not permanent, true. Does mental damage have to be permanent? If Namine had not devoted a year of her life to changing them back, they would be stuck that way. Murluxia had no plans to change it back. For his purposes, it was permanent.

Defacement of private property Jiminy's diary and Sora's charm was Murluxia's fault. The diary, as he he owned the castle, and invited Sora into it. The charm as he gave Namine the orders to do what she did. Those were her exact words. I would assume the charm was included in that statement."

Stitch noticed the sleeping judge. He noticed the bailiff looking the other way. An idea came into his head. He cautiously reached out of the cage through the bars, and...


SLAM!


Directing all his thoughts and malice against the judge and bailiff into the hammer, he brought it down, screaming, eyes closed.

Lightning filled the room, as 625 experiments exploded into being. A fire being got drawn to the stranger, while a mellow beat copying one walked up to Demyx.

Others chose to attack anything moving they could find.

In the confusion, no one noticed a tiny fissure appear on the gem on 150's forehead.

It works for him as well, discreet. He smirked to himself as the two boys on the opposite side thought that he was going to light a "discreet fire" when he actually meant that he'd light the fire discreetly. How can a fire be discreet? Meh, the idea was still almost the same tho, either way, there was about to be something that was going to light up on fire. Heck, if Pika_Power was here, Axel wouldn't even need to look for some thing flammable, his nice little tie would've done just fine. Unfortunately, Pika_Power was dead, so that was definitely not going to happen. Axel looked around the room for something, anything worth burning, the crazed pyromaniac tendencies burning in him deeply and excessively. Something. . . anything. . .
Axel definitely got his with though. He'd wanted action, and he got some. He was way too busy looking fro flammable things while the prosecutors were arguing over Flower Boy's charges and awaited the Judge's decision, and then SLAM! The gravel was slammed, and some sort of crap happened that sent the room into a frenzy.
"Yeah!!" He screamed out in happiness. FINALLY, something was happening and this was his chance, with all this happening, no one would really know who the heck started the fire. His first choice of target was that little blue alien thing, and with a snap of his fingers, a small fire lit up on it's tail, sending the alien in yet another crazed rush. Next, with another snap, all the black pieces of paper neatly stacked on the side tables combusted into flame, soon turning to flying embers of ash, which didn't take long to spread across the room.
Well he burned somehting, and it was good enough.
