    OOC: Actually, Kairi DID notice Luxord. She was confused by seeing a card pop out of nowhere, but then realized who it was and turned back to watch the courtroom drama. It was like, "Who was that?! Oh. Wait. It's just Luxord. Never mind." :xp: I'm surprised Demyx or Axel didn't say anything yet considering they happened to be on that side of the courtroom.

    Harvey frowned. "Alright, so then the total charges for Larxene would be...

    3 Charges of Aggravated Assault (Sora, Namine and Repliku)
    1 Attempted Murder (Sora)
    1 Premeditated Attempted Murder (Xemnas + those sympathetic to Xemnas and not Marluxia)
    1 Murder - by association - (Vexen)
    3 Counts of Child Abuse
    3 Counts of Coercion (Sora, Namine, Repliku)
    1 Count of Theft. (Sora)

    "These are just as they stand and can be negotiated as to severity and some may be worked on to be eliminated off. We just need to know what the Defendant wishes to do and her lawyers. Pika Power and I just need to know then if Larxene is going to keep her stance for sure. Then we can work on what we feel can be dropped or remain, lessened, etcetera." Harvey was a bit confused right now and just needed things to be straight now so that one case was over. Marluxia's scenario was worse by far and he imagined the charges on murder issues related to the Org members themselves probably would be auto-dropped, making Larxene's case not really meriting death at all. It was Marluxia that was going to probably be charged heavier because he was the leader.

    Sora sat up now intrigued. He could actually get why Larxene just wanted her trial over. It did seem kind of boring in a way to sit up there like that. But at the same time it seemed exciting too. The whole case was odd because where was the 'law' while these people were running a muck with no one at all there to put them in line? Seemed kind of odd to have a trial after all the facts happened, but in a way if it meant to make things clear and allow some people who may have been misunderstood to have a chance...he supposed that might be why. Because the Organization had gone about things so wrong, maybe this was to see if they could do things right. He supposed that was fair.

    Riku looked at Larxene and shook his head. She was pretty but also such a B. He wasn't sure if in normal circumstances he'd think she was kind of cool or not. After all, a girl that could kick ass and look good, have an attitude, that was kind of awesome. But she was also sadistic and liked to strike out at people. He did wonder if she would have been different if not encouraged by Marluxia or whoever, but it was not something to ever figure out. In a way he was kind of glad if she was done with her case. She kind of reminded him of how Axel had been...doing things so spontaneously, being intelligent but looking so hot headed. Riku had not minded Axel and even sympathized with him, which is why he didn't kick Axel's ass when he went to go kidnap Kairi, and instead just took Kairi elsewhere. He felt bad for the guy but could not let him make Sora into a Heartless again. He did see how Axel turned things around though for friendship and maybe Larxene could too. She was a tough egg to crack though.

    Xelax at first leaned back, almost as if he was intimidated by the savage nympth invading his personal space.

    But soon found the current situation quite comfortable... almost pleasurable, he then relaxed, "Why would you want to see my face? Showing your face to your opponent only make you appear vulnrable... besides nobody's never die when thier hoods is on." Xelax truly had no idea what he was talking about... but it sounded kinda cool... so he just went with the flow.

    He was distracted by Pika_power and Birdman both reading the charges at hand... it changed several times as they read it back and forth. Can't they agree? Xelax just shook his head. Might as well lay the final cards on the table.

    The defense witholds the claim of:
    -"Self defense on the assault charge against Sora. She didn't actually assault Namine with a weapon, but pleaded guilty to abuse. As for Riku Replica, she never assulted him other than self defense."
    -"No proof Sora was ever intended to be killed"
    -"Aha!" Xelax finally unfolded the documant he was holding for the longest time. "This is a notarized document signed by Xemnas. Saying he is willing to drop the charges of conspiracy and attempted murder against him. Marluxia and Larxene cannot be charged with this crime."
    -"This charge was not filed earlier... If you give me a moment I can probably get a notarized document from Vexen now."
    -"The defense pleads no contest to 1 count of child abuse. The count against Sora was self defense, the count aganst Riku Replica cannot be filed. As Riku Replica was a sentient being at the time of the alledged crime."
    -"By the witnesses own testimony... these charges can only be charged against Marluxia, Larxene," he gulped "was not the one who carried out the coersion."
    -"I could hardly believe that picking up a charm from the floor is considered theft. No attempt to take the item was ever made."

    He turned back towards Larxne, as though the case was a mere distraction... "Where were we?"

    OOC: As much as I think it's unfair that Xemnas dropped the charges due to *TwilightNight* playing as him (because that would mean both of them stacked the deck from the very beginning), unless the document could be proven as false evidence, I don't see why the charges shouldn't be dropped...unless the defense should've presented that at the very beginning. Isn't there some law that all evidence must be registered before a case? (You're not the only one who can use "State v. Lana Skye, ICSP. :p)

    Naminé couldn't believe it. Xelax was STILL trying to put off Larxene attacking Sora as self-defense. She sighed. There's no way that argument would hold up, especially since it was Larxene who attacked him first. As for the coercion charges...Yes, Marluxia was the one behind all of it and Larxene was the "sidekick." Which was kinda strange in a way. Was the defense sacrificing Marluxia for Larxene? If that were true, why didn't Marluxia object? Was he that confident that the charges wouldn't stick? It was seriously doubtful since the defense and prosecution had been piling evidence that would deem him guilty. Even Xelax himself wouldn't be able to get Marluxia off with only one charge.

    So, that's what it came down to. If the defense got Larxene off of everything but the child abuse, then that would mean they'd be condemning Marluxia due to all the evidence that had been presented. The tickle-torturing Pikachus punishment seemed like the only sentence that Larxene would fear (if she could feel fear) the most. Solitary or the death penalty wasn't exactly fitting for Nobodies that had already died...

    "No, it was no self defense with Sora. The scene is this:

    Namine is on the floor, hurt.
    Sora is on the floor hurt.
    Larxane runs towards him to attack, yelling "nighty night you sham!"
    Goofy blocks her.
    Larxane threatens them then attacks.

    So, see it? She runs towards Sora, presumably to kill him, as the plan was in ruins. He was hurt on the floor. He only survived because Goofy blocked her. She was not expecting him to intervene, she was expecting to hit Sora.

    Oh, and Larxane went to attack Sora the first time, as she says to Axel 'I just want to play with the toy, not break him' she planned on attacking him. She knew about the memory change, she tool advantage of it by doing the right actions to coerce him into attacking her."


    -"No proof Sora was ever intended to be killed"

    "She was attacking him with lightning and kunai. They could easily have killed. I don't know about you, but I do not use knives to knock someone out. Besides, if Sora had not succeeded in finishing her off, he would have died."

    OoC: Pika_power is trying to say that if you loose, Sora dies.

    The pokemon turned to Harvey. "Can he do that? I know for certain charges it is different, but can he just decide not to press charges? After all, it is us who is charging her."

    -"This charge was not filed earlier... If you give me a moment I can probably get a notarized document from Vexen now."

    "Aha! I know he cannot simply drop the charges. In murder cases, it makes no difference if the victim intended to die or not, the murderer still is charged. This may be the same with the conspiracy to murder Xemnas." The pokemon added under his breath "I hope..."

    The pokemon did the classic "fall on side of face. "Please repeat that. You said 'the count against Riku Replica cannot be filed. As Riku Replica was a sentient being at the time of the alledged crime' So if he was a sentient being, why can the crime not be filed? Oh, and the Sora one was not self defense, she dashed towards him to attack and was stopped by Goofy. Besides, I think that getting Namine to change Sora's memories would count as abuse as well. That is mental damage. Same with Repliku."

    -"By the witnesses own testimony... these charges can only be charged against Marluxia, Larxene," he gulped "was not the one who carried out the coersion."

    She was aware of it, and was happy to use it when it suited her, when she coerced Namine into changing Riku Replica's memories.

    Look at what Larxane says. It seems as if she has been caught in the act of coercion, no?

    So even if she does not get Coercion, she will get coercion by association. (or whatever the charge would be called.)"

    "She attacked him and took the charm, then picked it up. She only lost possession of it when Sora reclaimed it by force. If he had not, she would have destroyed it. If she takes it from him, then threatens to destroy it, that certainly seems to be thievery. If Sora had not acted, Larxane quite possibly would have destroyed it."

OOC: I'm actually surprised when I read ICSP's post myself (yeah, he didn't tell me that, though I guess since we play Xemnas , it was common sense), because I was planning to actually discuss what Xemnas would do first, so it wouldn't be unfair like that. Yet...what's to be is to be unless it could be retracted :/. Though if you ask me, I really honestly think that Xemnas would've chosen to drop it. The punishment for traitors in the Organization is obvious, and it happened in the time of need, so that's it. That, and I can't think of how Xemnas would take the court here to give them a lesser sentence to said traitors. And if there was to be any punishment given, it seemed to be right for Xemnas wanting to do it himself. Erm, that's what I was planning to discuss ^^;. I think we can still go over I though...

    Janexna had to answer to this one in particular. "So she attacked him with lightning and kunai. Is just like there's a hard metallic key that coud literally blow or beat someone dead in reality. Is just like Axel's chakrams, who's pointy ends should've stabbed enough to kill where there wasn't even a need to be a second battle, and Sora never dies. All you get is that he's K.O.d in the game. That's the thing, is a game...fighting with weapons, is like fighting with Sock'em Boppers or something..."

    She shouldn't have said that, because now she had the jingle stuck in her head. Sock'em Boppers, sock'em boppers! More fun than a pillow fight! Blow them up, put your hand inside, get ready to have, the time of your life! Sock'em Boppers...

    Janexna shook her head. What the hell was wrong with her? Though she noted that it was like the Power Rangers theme...great, now she had that stuck in her head. Go, go Powe-

    She got a grip on herself.


    "No. She attacked him, but while she was doing so, the charm had fallen out by itself and clattered to the floor. It could be seen in the scene itself by watching how Larxene hits Sora, that she wasn't aiming for that objection. When the charm was on the ground, she picked it up. It could not be proven by fact that she was going to destroy it, if not, just merely taunting Sora with that so that she would see his reaction, which would make more sense. Bet she didn't expect for him to hit it out of her hand like that, though," Janexna stated, remembering to herself that's what must've gotten Larxene pissed considering the look in her face after that. "That's a possible canon outcome that can't be refuted, and it should not be unheeded, which is why I even said so in the first place. Is not for my own benefit here."

    Those were little nitpicks though, and she went for the real reason she was responding.

    "And now that Vexen's added, I bet Larxene said something when Marluxia told Axel his order, and she talked it over with him here when there's no such conversation, because in the very scene it was decided right there Vexen's death order because of what he was doing, and apparently....Larxene had a hand in it, she probably even sent hand signals to Marluxia and put a finger slash across her neck, or maybe Marluxia could lip read and that's how she could be charged. For the quote of her saying testing Axel, considering he had gone, leaving Larxene and Marluxia alone there for Marluxia to explain what the order was about while Axel was taken care of it, this could be deduced. Your Honor, all you have to do is see the video, and that would be answer enough that doesn't need to be explained. Maybe we should present the scene again to see the nonexistent 'association' Birdman has now placed," Janexna replied in a very sarcastic tone once hearing the Vexen charge, shaking her head unbelievably.

    She thought anything where Larxene is in the room would be considered coercion or association. Seriously. It was getting kind of ridiculous in her opinion, and here she was thinking the charge of "theft", God forbid someone picks up something on the floor, was bad enough. The only coercion she could see was the one with Repliku. And she was honestly lost on how could Larxene's words to Namine, for the rare times they interacted, which was two, could ever force the girl into anything. She really did try to see it, but with Namine saying Marluxia threatened her with keeping her locked up forever as a permanent incentive for the girl to alter Sora's memories, which was proven to be a direct quote, she just couldn't. And maybe for the first time ever, she appreciated that Mr. Power at least sees the things that were said, or be more fair, despite the fact that it bothered him to admit it. It appears he wasn't as hotheaded or ravish into blaming as before. Maybe it was too soon to judge (pun not intended) him.

    Feeling a piercing stare on her, she found Larxene giving her one of the most deadliest glares she had yet to see from her, the expression reminding her of what she had sworn to. Janexna did send her a apologetic look, and stopped herself, a bit guilty that she went on when she had promised, but the unfairness was blatant in her eyes, and it irked her. She had to say something. Still, as Larxene didn't want to be defended, there was nothing she could do, but take the slaughter that were being put against her. Before doing the final decision though, she stared over at the blonde, sternly replying slowly, "Are you sure this is what you want, Larxene? The things they're putting are making it seem more like a crime than it really, truly is..." And it was killing her. However, she got a firm nod from Larxene, but even then she was reluctant.


    "Just do it, as I said, I've made my decision and I won't change my mind....let the prosecution think what they want," Larxene somewhat encouraged tightly, though also a bit genuinely surprised that she got Vexen on her charge now for whatever reason was going through this Birdman's mind. She was even more surprised that Mr. Power, the yellow thing (she didn't know what he was yet), even somewhat agreed to some of the arguments, as small as it was. It made her think that it was perhaps Birdman who she should be weary of. Again, though, it didn't matter to her. Now she was being more determined because of that, and the truth of the court room and its twisted versions were finally rearing its ugly head. If she ever wanted to be defended, it wouldn't be right now anymore.

    She nodded, and now looked over at the judge, closing the case, then. Janexna didn't know she would feel such disappointment in this, but it was to be taken. She tried her best to convince Larxene otherwise, yet it was for naught. Breathing a sigh, she gave a serious look to Xelax, asking him not to defend, since that confused her a little, and it was only keeping on the trial going, which was why she didn't answer to anymore of Mr. Power's words. That was it. It was over. And it was then she spoke. "First, I would like to apologize for my loose of words there when my client did not want me to. Let's just...just finish it. So, for the matter at hand, the Defendant has decided infinitely to end her trial, and in final, no going back. Though I think it could be possible, considering we've gotten really far on the case to go over almost everything, including the Vexen charge now, for it not to go to waste, we can set the list of charges, to determine the decision for each after checking the arguments put all around them until now, and see the final verdict you choose, your Honor. I do believe that's the best path to conclude all this, and you can even do it now or after all the members are done. Is only a suggestion, so, is really all up to you whether to do that or just close the whole thing, Sir. And the prosecution."

    And she waited, a bit upset at the turn out of Larxene's refusal. Favorite character or not, the girl was like trying to break through a thick, strong, solid boulder.

    The pokemon looked disappointed. Over already?

    "But you have not refuted much of the prosecution's argument. To stop now would be to hand much of the case over to us!"

    Adressing Larxane, the pokemon said "This court brought you back from the dead, correct? Do you really think that such a court would settle for simply returning you to your death? No, I would say it is much more likely that you will get another punishment. Who knows, it may be transformation into a pokemon, if we choose to go down the mysterious dungeon route. Could be a job as a flight attendant. Anything could happen. Consider that."

    Facing Janexa, the pokemon stated, "As everything you said about the Vexen argument was against your client's wishes, it is null and void."

    Finally turning to Harvey, "Can they get off the hook from having charges retracted by their own members?"

    Luxord listening in on what the sharply dressed pocket monster (Where'd you think they got the name "poke'mon? A crackerjack box?) said, all while not showing his disdain. He waits for the poke'mon to return to his avian, adult-swim partner.

    He quickly writes on a card with a nearby pen, writing "I think you'd make a great Electric poke'mon, like that one unevolved version of Pikachu, they're cool." Luxord scibbles in. In which case, despite his high grammar, his writing sucked.

    He then puts the card on the ground for it to find its own way to Larxene.

    Harvey shook his head. "Sora was attacked when Larxene was saying 'she's the bad guy' and she kicked him knocking him back several feet with no provocation. He had not attacked her at the time. This is the moment I speak of. That is aggravated assault and/or assault. It stands."

    "She cannot get off on just a physical abuse charge for Namine either. She slapped Namine very hard to the side and that is by all accounts Assault."

    "Tossing Repliku to the side, whether he's not 'operating' as you all want to say or was is not important. You don't throw a person several feet to the side and their body collapses to the ground if they are having a stroke. That would be seen as utterly cruel and I am not sure how it is avoided in this matter. He -is- a living being, whether people still want to call him a 'doll' or not. What Namine did to him does not remove his -sentience- at the time. He would be considered to be in a comatose state. No one would go to throwing someone who is in a coma around and not be charged. He was incapacitated and helpless and she tossed him -like- a rag doll. This charge stands of Aggravated Assault. He could in no way defend himself."

    "As for Xemnas's right to drop charges against Larxene for the planned death of Vexen and also her betrayal charges or anything connected on that front, Xemnas has the right as he was the official authority in charge to administer 'justice' to the Organization members under his leadership. It will be honored."

    "As for Repliku's scenario of dealing with being told he is forced to have his memory wiped, reacting and Larxene hitting him, that charge still stands as he was a minor that was being forced to have his very mind altered and it is SHE who took him after to Namine as well. I can imagine he did not just go 'peacefully' by the very end scene where he is crying out against it extremely dramatically. She forcefully took him against his will after hitting him far harder than necessary in the similar manner she did to Sora who was just standing there. The charge of Aggravated Assault remains."

    "Therefore the charges are as follows that will stick and need to be confirmed and not continued to be argued upon any further."

    3 Charges of Aggravated Assault (Sora, Namine and Repliku)
    1 Attempted Murder (Sora)
    3 Counts of Child Abuse (Sora, Namine, Repliku)
    3 Counts of Coercion (Sora, Namine, Repliku)
    1 Count of Theft. (Sora)

    "Please, your Honor, can these charges be finalized so that we can move on? Xelax can continue to debate but he is going in circles and none of these counts will even merit Larxene to have the death penalty as the most severe charges were removed by Xemnas and his penalty would have been outright death for betrayal at all in the first place. The theft is also not such a grand thing and we could part with that charge as it is a petty crime and he did in the end have it recovered to him. The other charges are fair and balanced and we don't need to continue the circus that keeps being incited by trying to disprove what has already more than been made clear."

    He gave a look at Pika Power as well. "Can you please go along with the charges here and not add anymore or alter it? If you need to alter it, let's talk but I do not think any other charges are going to stick as there is not enough viable proof."
     
  12. Janexna shook her head. It seems Mr. Birdman likes to think that everything he says is right and should not be countered, because he simply takes it that way and that's how it should be, from the vibe of his words right now. Like the account of theft and the attempted murder of Sora (which she knew that if Larxene did defeat him, it would be considered K.O.d instead of being murdered like a normal fight, not to mention, the said words Larxene uttered can spider through all different meanings like she had presented. On Birdman's side, those were unfounded as much as hers), and he appears not to look it any other way, but his own. Those two should at least be dropped, in her opinion, as they are the most hypothetical, and it really depends on the point of view in the person, and does not stand as fact. The only coercion she could agree with is the Repliku one, maybe coecing Naminé to do so, but that also cannot be proven, considering how many people were in there, and how many could portal, and that the scene was NOT shown to dictate. Also, as been evidenced by her canon quote, Naminé wasn't force by Larxene into anything. Sora....she wasn't too sure about, she'll see the judge's decision on that. Very, very, minor severity of coercion, if that was the case. She thought the Aggravated Assault was useless to add, and she was going to say why:

    "Your Honor, for a last final word, wouldn't the Aggravated Assaults fall under Child Abuse? The assaults were given to what we consider children. As you can see, the assaults are the main reasons why Larxene has been placed the charge of abuse in the first place, so the three counts for assaults are the same for child abuse, to which is why my client pleaded guilty for it. So I think, that is better to cross out the 3 Aggravated Assaults, and simply leave 3 Counts of Child Abuse as permanent, and the assaults would fall under that category. I think is tedious to have the same thing put under a different name."

    Repliku "reacted"...wonder what reaction was that. It was still a charge to hit and Larxene had to counter it in self-defense, no matter how much Birdman was sugar coating it. She was sure the Savage Nymph wouldn't have even touched him or even bothered with Repliku if he didn't do so. It would've saved them both from the charged coercion.

    The "theft" was still stupid to her and was just there so the list is bigger like the attempted murder of Sora because "nighty night, you sham" and "your funeral" were outright hints of murder apparently. So she wasn't going to think much on that. And she somehow wished Xelax didn't go over the Repliku thing again.

    Of course, she wasn't going to say any of this outloud, it was more like a summary to herself and what's been argued this whole hours(?), as now it is time to wait for the judge's final decision. Hopefully, he will go over what all of them said cautiously and put on a balanced verdict enough to be fair, yet enough to teach Larxene her lesson, though she honestly didn't know how the girl will take it, no matter the minority of it.


    Marluxia just sat patiently, not at all fazed by what the attorneys brought up about him, though a bit angry at how easy he was to be thrown that way. He did think this whole court session was a type of joke. Not as severe as Larxene, but it was really much more like watching, then really being in anticipation and/or be anxious of. And with what he has done, the attorneys were going to have to pull many to try and get him out of this. Maybe he could save them the trouble, and plead guilty to all charges now, unless they had a argument to lessen one. It was then he decided to wait for his turn, and see where his trial went...by now, he wasn't sure himself. Still, he had known that Larxene's charges were not to be taken so seriously, and they needed to prove that.

    Larxene had laid her head in the table on her arms, her face hidden as she closed her eyes, not wanting to hear it any longer. At least Janexna took her word and did not say anything. And now, they waited, not her. She was over it and done with.

    Pika_power looked at Harvey. "We can get the conspiracy charge to work. This is not a personal trial, where it is Xemnas against Larxane, it is a public trial for the good of the public. Whether Xemnas drops the charges is irrelivant. It still needs to be taken into account for the public's safety. Besides, it is not Xemnas pressing the charges. As I have Roxas as a witness, he was part of the org at that time. This means that Roxas can press charges, as he may not want the org to be overthrown, correct?" Turning to Birdman, he asked "How are we going to get theft on there? They have a good defense there.

    Naminé was listening to both sides and realized that they were all thinking too small. They were so focused on bringing justice to those who deserved it that they hadn't thought of what would happen afterward. The sentences would be carried out, but then what? Would the Org return to the nothingness that they came from? Would all that were here today return to their original worlds with no memory of what happened? A mysterious force brought those that were slain back to the living realm. He or she could technically end the entire ordeal. But maybe she was thinking too much. Right now the trial was what mattered.

    Kairi listened thoughtfully at the charges. Overhearing Pika_Power, she disagreed on the count of using Roxas to press the charges against the Organization. After all, he was branded a traitor himself and tried to leave the Org. He had no lying loyalty toward them so the point was moot. But she agreed with Janexna and Harvey about dropping the theft charge. Like Harvey said, it was a petty crime and Sora did get back her lucky charm in the end. And granted the Child Abuse and Aggravated Assault were different crimes but with the same instances.

    In her opinion only the 3 Charges of Aggravated Assault/Child Abuse, the Attempted Murder and 3 Counts of Coercion still stood.

    Of course, it was all up to the judge. She looked up at him curiously. Was he...asleep again?

    The pokemon was certain he was missing something. Murder could not be 'dropped'. He was unsure of the souce, but he knew for suicide cases, people who help administer the death can be charged for murder, even though the victim wanted death. Here would be the same, wouldn't it?


    What was that nutter on about? Roxas was completly confused. He had just heard he was pressing charges against Larxane for comspiracy to murder Xemnas. Until five minutes ago, he did not even know there was a conspiracy. Turning to Namine, Riku and Sora, he asked "So what exactly am I pressing charges over?'

    Naminé shook her head. "If I were you, I wouldn't get involved in this. You weren't in Castle Oblivion, so you wouldn't know what was going on." She gave a sideways glance at the Pokémon prosecutor. "Roxas, just leave it be. Doing anything without knowing what you're getting into will only cause more confusion and unnecessary grief. That prosecutor doesn't know when to take what he can get. Larxene's already being charged with numerous stuff. Adding the conspiracy charge back in would just make this trial go on for another twelve hours and we all want to slam Marluxia down already..."

    "After reviewing the charges and the evidence..." he started, looking at the notes he had been making. "I'm going to have to drop a few charges. Child Abuse constitutes and includes assault against children, hence all counts of aggravated assault will be dropped. Also, the attempted murder charge will be dropped, as, Ms. Larxene's opponent was clearly not in his right mind, and struck first, as portrayed by this evidence here -

    He cleared his throat before continuing.

    2 Counts of Coercion (Sora, Namine)
    1 Count of defacing private property. (Sora)"

    He looked around the courtroom once more before continuing.

    The first electric pokemon pricked up his ears. What he heard was not good. Roxas was having second thoughts about pressing charges. He would have to try to push through on the suicide analogy alone. "Damn."

    "I object!

    She already kicked Sora away in self defense. She then made to throw Kunai at him while he was wounded. That would have been fatal. She was only stopped by Goofy, who deflected the blows. Sora tried to get up multiple times, but could not. She cannot claim that going to kill him was in self defense.

    As for Vexen being Repliku's legal guardian, so what? Ripping someone's memories from them is surely considered a crime whether you have got the guardian's permission or not! Even minors have rights!"

    The pokemon thought for a bit.

    "Also, child abuse can be merely withholding love. Aggravated assault is different. Two charges can be in one crime."

    OOC: Okay there are a couple of issues to raise here. Why are people now saying that if someone goes down that he is just KO'd until a potion is dropped? If Sora LOST the fight all the way with Donald and Mickey they are considered DEAD. The game is over. Also, Larxene -did- intend to kill him. The whole point of the game change shift was that Larxene and Marluxia tried to kill Sora and Zexion was out to murder Riku.

    Can we please stop trying to add things to the Defense that are like "He'd never go and die because in the game mechanics it can't happen unless he loses utterly" please? That is not evidence to support anything. It's the second weird charge thing contested because of how the game runs which is kind of a kid's game in the first place so of course if Sora 'dies' we just get the screen of him floating.

    "Pika, we do not need to bring Roxas up there to go against Larxene as he didn't even know her, most likely. You have two other witnesses to call or one of the Org who knew her and what is the point? Let's wrap it up so we can negotiate the terms of lowering some charges with the Defense if we are going to and Larxene can be done. The theft is not that important and would be dropped in negotiation anyway. Let's not hammer away at something that is a petty thing and since the defendant here is just wanting it over, we can go in the back and talk to the Defense and negotiate final charges with the Judge and be done.     Harvey sighed and addressed the court. This was going nuts and the charges were very clear to him. "Child abuse is to mark the point that they were -kids- who were attacked, taunted, neglected and mistreated. Child Abuse holds for all three cases due to the fact that they encompass more than physical abuse. They are separate charges from Aggravated Assault charges which were wounding someone of any age physically in an assault and battery type way. They stand separate even though they coincide and support one another. They should stand. I am seriously not thinking I need to go down the list and prove each count once again. As for the theft, if Pika Power would agree, that charge can be removed as it is a petty crime in light of all else going on."

    "The murder attempt should also be present as the Defendant clearly said those words and this is a time in the actual events when Larxene sought to murder Sora clearly and Zexion also attempted to murder Riku. This is plainly clear in the evidence."

    "As for dropping the Coercion attack on Repliku, I do not see how it can be removed when he was attacked against -HIS- will and this is not just telling a kid to go and do something because daddy said so. This is mind raping him. You are clearing the very fact that she forced this boy to be mind raped, pure and simple. That is coercion. Technically it could be a worse charge whether a parent clears it or not. I was going LIGHT on this."

    He turned to Pika Power again after addressing the court and said softly... "Also, as I said, I'm willing to go with what Xemnas wants if he does not wish to press charges because at the time and place Xemnas was in charge of them. They are like their own nation/city state in that regard. His own judicial system would have been adhered to which was 'death' if we were to decide to follow his stricture guided at the time. I do not see why the defendant should have a sentence carried out so strictly if now at this time, Xemnas would not opt for his own judicial law to be carried out. Betrayal and attempted murder of a person in a society usually merits something very harsh as a punishment whether life in prison or whether it be death. Are you saying you want to keep tacking these on when clearly it means the doom of her, when she could be, as other Organization members could be, rehabilitated, understood and possibly assisted to exist at all? Her crimes are severe, but there are people with worse scenarios and if we add it here to Larxene's, we also add it to Axel's, Marluxia's and Roxas's, which Axel and Roxas are two members that turned things around and Marluxia will already have a ton of other charges against him as well."

    "So in simple, Pika Power, are we truly out to just kill off the Organization, marking all members as non-repairable for crimes against themselves when they all possibly had reasons to do these things? My angle on this was to get them charged with what they actually did to others outside of the Organization because it is clear that these are the charges that affected others and worlds and infighting between themselves, they knew the penalties from Xemnas. Most of them -died- any way because of their stances against others of their own ilk that put them in positions to do what they had. Especially at Castle Oblivion if you think about it. If the Organization members had not been fighting over power and control, to push things, they would have not died there, manipulated Sora, Riku and Namine there, etc. This is why I don't wish to include the charges if Xemnas does not."

    Harvey looked over at Xemnas. "I must ask you sir, for a straight out answer so that we do know what direction to go in now. Since you are present, and I do not wish to just go by papers, do you wish charges against your members who betrayed you to be permitted into the court rulings or do you wish them to be removed?"

    The judge sighed before answering.

    "The only one I see throwing anything is Goofy."

    The judge chuckled, then looked the Pikachu dead in the eyes.

    "Is that so? It is up to the Guardian to decide what's best for the person he has legal custody of. None of his rights were violated. Clearly, Vexen voiced his opinion that it was in Riku Replica's best interests."

    "... Beware the mind-taker, Birdman. Child Abuse is the physical, mental or sexual abuse of a minor. Which would encompass assault. Which would make adding aggravated assault a redundant charge." the judge stated flatly, raising his eyebrow at the prosecution.
