  1. Janexna went to pay no mind to Birdman again, who was becoming quite obnoxious now on the fact that Xelax had no prove. Whether it was from frustration or simply prevailing on that matter, she didn't know, but she was trying to ease the court up. Staring back at Xelax, she simply added in to his statement, "True, and they probably did start this, but it stands most of all that Naminé isn't the one on trial here, and she's now being tried as a witness, where it shouldn't be debated now whether she could portal or not. The thing is...this topic is at the wrong time. Just wait until Larxene and Marluxia take a stand to argue this, so you can defeat the point of their charge against child abuse or coercion. That's the best route to go. The prosecution will only keep going with that reason. I'm not saying to drop it, just hold it off for a second..." At this, she let out a breath, a bit cornered, as Xelax needed more prove than what he's giving. "Though, do you have prove about what you claimed? Cause I have nothing with me right now..."

    Even Naminé was getting a bit impatient. Janexna was right. This was about Larxene, not Marluxia or herself. She only came here as a witness, not the defendant. "Your Honor," she said politely, "I believe Mr. Xelax is attempting to stall for time. He seems to keep pressing an irrelevant point in an attempt to "find my twitch" as it were." She gave Xelax a hard stare. "I came here to answer questions, not to be accused of something that you believe I did. I mean, really now. You seem to take after Mr. Gavin in more ways than one." She sighed. "At least when Mr. Wright or Mr. Justice ends up in this type of situation, they know when to back off on their way of thinking and look at the case from another angle. In other words..." Her eyes narrowed impatiently. "...LISTEN TO YOUR PARTNER."

    Then she addressed Ms. Janexna. "If you check the Court Record, you'll find that Mr. Xelax was the one who brought up the theory, not the prosecution..."

    That is what he stated. But no one has actually defined it. So I'm going to quote the following from http://www.childwelfare.gov/pubs/factsheets/whatiscan.cfm:

    She looked at the judge apologetically. "Forgive me, your Honor. I know I'm talking out of turn and it's the prosecution's job to do this, but Mr. Xelax has been constantly pushing a point that has long been proven irrelevant to the current defendant and I feel that everyone in this courtroom would like this matter dropped for the time being. So, please, unless the defense has any actual questions to ask me instead of accusations as this is supposed to be a Cross-Examination, I'd like to step down from the stand as there is no real reason for me being up here." Naminé took a deep, cleansing breath. "And in case you're wondering where I got that info from, I did some quick research during the break."


    Kairi was stunned. She had just talked out of turn against the defense themselves. She could only imagine what the judge would say about all of this. It didn't look pretty. Kairi gripped Sora's arm tightly cutting off the circulation. This was about to get ugly...

    Sora held Kairi's hand watching curiously. This was all pretty tense. He pondered how many people were going to be witnesses that instead turned to being on trial instead. It could happen to anyone which made even wanting to be a witness questionable. This court case was exciting in a way, but also draining. He wished they'd let poor Namine off the stand already. She was taking matters into her own hands since the Defense was pretty well ignoring the offense and the judge was waiting on evidence that didn't exist.

    Sora tried now through his memories he had just gotten that would be forfeit when this was over to consider the Defense's side. However, he remembered all too well about Larxene and Marluxia and how they had been. He wondered if Larxene would not have been a better person had she not gone along with what Marluxia wanted. To Sora, the Organization at the time had confused him and he was losing his memories so dramatically that he'd forgotten things even down a couple floors as he went on. Vexen was very confusing and just had wanted to test him. Larxene was baffling but at the same time she made it clear to him she was 'the bad guy' as she had said. Marluxia...he just seemed to be a really rotten guy. Even if the Org had their reasons for things, Marlulxia had just seemed bent on using Sora for power. Sora could empathize with a few members of the Org, but others were harder to comprehend. He supposed that was because they were missing their Hearts.

    He let out a small sigh as he thought about Larxene though, because it was she that was being debated now. He didn't remember much at all that was nice about her. He did ponder still though that was this because of Marluxia, who had been crueler than she was? He wanted to be fair. After all, he didn't have to fight the Organization anymore as this was a court case. However, he began to wonder with all of Namine's troubles up there if he really felt comfortable himself going up there after. There were 12 members on trial since Roxas couldn't really be since he was a part of Sora. There were some things Sora had figured out from Roxas's side but not enough that he could really see them trying to put Roxas in this. He patted Kairi's hand. "It'll all work out. You'll see." He hoped she'd feel better. They just had to let Namine off the stand sometime soon here. He'd try to remain optimistic even if he was getting confused at the accusations flying about.

    "Though somewhat out of turn, Ms. Witness, you are right." the Judge said to Namine. He sighed and looked at the Defense. "All you've done is prove that the use of Dark Corridors is taxing to one's heart. A heart which a Nobody OBVIOUSLY DOES NOT HAVE. Consider yourself penalized."

    With that, the Judge slammed his gavel.

    !!!!!

    "One strike. Four more and you'll be joining the audience on this case Mr. Xelax. I pray you don't screw up again. Now, can we proceed with the charges against the Defendant?"

    He bid Namine to return to her seat before he turned to the Prosecution.

    "And the next charge against the defendant is...?"

    OOC - I had to come up with the penalization system on my own, basing it off the ones from AA1 and 3. The only way to punish an attorney is to remove them from the case and/or declare a verdict that is not in their favor. However, since there are two representatives for each side, I can't do the latter unless both fall. So I'm going to have to do the former. This system applies to the prosecution as well. Such a display will not be tolerated on your parts because you're the ones who're pressing the charges. So no pointless flailing about, okay? Also, I'll be the one keeping record of the 'health' of each player, so don't trouble yourself too much. Just keep in mind that if you screw up too badly, things will not work out in your favor.

    OOC: Fair and to the point, Udgey-boy. :p But yeah, at least we're finally getting somewhere. The next charge would be...

    Manipulation of Namine.
    Child abuse.
    Manipulation of Sora.

    Conspiracy to murder Xemnas.
    Attempted murder of Sora.
    Assault.
    Theft.


    I'm assuming we've already proven the Manipulation of Sora and Child abuse charges already...or am I jumping the gun here?

    OOC - Welp, from Namine's testimony, they were manipulating her to manipulate Sora. And since the Defense couldn't prove otherwise, both have been proven to be true. :\
     
  7. OOC: Is jumping the gun too soon. The only thing I was aware of was that Naminé was being put on trial. So unless I get a brief summary of what made the decision of which I apparently missed, I'm going to have to for ICSP.

    OOC - ICSP claimed that Namine was the one doing the manipulating. He failed to prove this.

    OOC: Yup. That would be pretty much the argument that has been going on for the past few pages in a nutshell. :dead:

    BIC:

    Naminé plopped down into the seat next to Kairi and let out a long sigh of relief. "That...was messed up," she said. "Seriously, I'm trying to figure out how the defense is really viewing this case. It's like there was no common sense at all in any of their arguments except when Janexna told Xelax to drop the point for later." She shook her head in amusement. "The only woman in law and she seems to be the only one on the defense that has their head on straight..." That's when she realized...

    "Hey, uh...guys?" Naminé looked around the audience booth, but didn't see who she was looking for. "Has anyone seen Roxas? I haven't seen him at all ever since the trial started."


    Kairi looked around too. "You're right. In fact, I don't even remember him being with us when we were summoned here to the courtroom in the first place."

    "You think he's alright?"

    Kairi patted Naminé on the shoulder. "Don't worry. He'll show up." She gave Naminé a confident grin. "It's not like he's being held up by a Heartless swarm or getting the crap kicked out of him by Dusks. He should be fine..."

    OOC: I can only imagine that Roxas IS getting the crap kicked out of him and he'll show up beaten up, but victorious. Maybe he was looking for the last Nakéd juice at the store for Naminé and had to contend with a bunch of crazy health nuts...:sweat:

    OOC: I assumed Roxas is with Sora unless told otherwise. Sora basically knows Roxas's part in things in brief and it wasn't that much to begin with at this time so doesn't really hold relevant as to what Sora couldn't say.

    Harvey Birdman gave a nod at the Judge's verdict. He then looked at Pika Power. "Who do you want to call to the stand now?" He decided to let Pika do it in order to keep the Pokemon busy so no more bouts of stray bolts went out or fights over Skittles. They needed to focus and get serious here now. The heat was on and it was far better to try at least to be professional.

    Sora was glad Namine was now free of the stand. He waved to her and let out a sigh of relief. At least the judge was making sense of this catastrophe that had transpired. "Welcome back, Namine" he whispered pleasantly. "Good job holding your cool up there."

    Repliku was resigned now just watching quietly and thinking about the things that had all happened. He was curious what the new direction would be with new people now called forth. This was all pretty tense and since each Org member was going to be tried and charged individually and called forth as well as those from each circumstance, he knew this was going to take a while. Why weren't there any concession stands around again?

    Riku gave a nod to the Judge respectfully and then looked at Namine as she walked over and plopped down next to Kairi. "Glad you survived. You'll probably be going up again though soon enough. Larxene probably won't get as maximum in charges as Marluxia which then it's going to be more of a fight." Riku was always the mental thinker. He also sometimes was the doomsayer. Poor Namine.

    Pika_power resisted the urge to punch the air, and instead did a curt nod.

    "We have proven that Larxane beat Namine, and coerced her into changing Repliku's and Sora's memories.

    Now, I still think that the defense should have a last chance to change the evidence they have given, simply because one defense Lawyer went against the wishes of the other. So, a last time to prove that Larxane did not hit Namine aside when protecting Sora, and a last time to prove that Larxane did not coerce Namine into changing Repliku's and Sora's memories. No outrageous theories without basis. Just simple, easy to get evidence.

    Oh, and thanks Judge Erkz, for telling me your name."

    Pika_power then turned to Harvey and whispered,

    "I cannot think of a witness for them plotting to overthrow Xemnas... Am I allowed to call on Axel? Might DiZ know? "

    Kairi and Namine stared at the enthusiastic Pikachu and both did a face-palm.

    "I think Mr. Power should've left the issue alone," Kairi whispered.

    "I know," Namine agreed. "Bringing up the subject again will just cause everyone grief and we'll NEVER get past Larxene." She rolled her eyes. "In other words, 'Stop while he's ahead', right?"

    "My thoughts exactly."

    OOC: Who's running DiZ any way? I would if no one wanted to since I seem to have other prosecution peoples and I think I could run him fairly if no one else is. He is a rather difficult character to run just as some 'npc' because he would know the whole details probably.

    Harvey was beginning to wonder if Pikachu was on their side lol. At any rate, he shrugged. "If that is your thought, I suppose go for it. However, normally I'd say to go with the kids first so that each count can be placed or not and use DiZ and King Mickey as witnesses afterwards to explain information that happened that the kids may not themselves know in closing to support the charges. Larxene's and each Organization members' case is not going to just have 1 charge of assault, abuse and all that. There will be probably more and then we negotiate down how many charges stick. So DiZ and King Mickey I think should be reserved for after the kids. Axel is someone also I think should wait till after the kids due to his position of being in the Organization and having information in a way that again, the kids would not. Are you seeing my angle here? It's going to be Axel, DiZ and King Mickey that probably get their cases mostly challenged because of the fact they knew more that was going on and it can back the kids or get some charges alleviated off Larxene and each other member there."

    "I wonder if he's going to call up Sora or Repliku..." Namine wondered. "They experienced her wrath in the first place."

    "But what charges are left? There's the conspiracy to murder Xemnas. Axel would be the most reliable witness in that case. There's the attempted murder of Sora. Sora, Donald, Goofy and I could testify to that. Then there's assault. Repliku, Sora, and I were victims to that. And there's finally theft. Sora, Donald and Goofy could do those too. That is IF they're talking about the changed lucky charm that Larxene grabbed."


    "It's too bad neither of us are lawyers," Kairi murmured. "We'd have been able to give this information to the prosecutors down there."

    "We're just going to have to hope that they're having the same line of thinking we are at the moment."

    OOC: Thanks. It helps to read the first page again, doesn't it? durr.

    "The charges don't work just in proving one person was abused. Just because Namine had one charge added of some of the charges there each doesn't mean there aren't 'multiple counts' so each 'kid' has to testify that was part of it and dealt with her. The other charges will also probably be expressed but the Defense doesn't want to use Namine to go at them or not. This is probably a good thing though since they were trying to charge Namine with the conspiracy in the first place. The other kids and DiZ and King Mickey can't be charged the same way." Riku sipped his soda and waited. He did hope things would go more smoothly now and all but something told him that there were angles to look at that he wasn't picking up yet. He would keep mindful and watch each thing to try to keep up.

    Sora of course would watch too, but some things were harder for him to focus on. He was not one who really cared for all of this stuff other than the fact it could be exciting. He pondered if in the future he would have to go through these sorts of things often and if it was part of being a Keyblader or not. He realy needed to focus but was probably a contender for ADD at times. He tended to miss the obvious things other than how people felt. He was usually pretty good at that sort of thing. "Do you think the Organization has changed at all?"
     
  16. "I do not think that calling one simple argument a win is right, it seems the prosecution is too fast on calling victory like if it's given to them by only one source of a point. For anyone who has played CoM, one or both versions, concerning Larxene, she did much of nothing on manipulation, as I will explain on why. The events of Castle Oblvion is tricky in the fact that everyone was at fault in there somehow, though Marluxia and Larxene can't be completely blamed for. Before I continue though, I will like...um...to call Larxene up to the stand," Janexna finished somewhat nervously, her eyes shifting behind to see if Larxene was there yet.

    "What for?" Larxene asked loudly in a snipe as she came back through the wooden doors, only to hear she will be up there in the God forsaken chair being looked on and prosecuted. Fantastic. There was just nothing positive to better her mood, was there? She was even shocked at herself for lasting this long without lashing out. She really did not understand what was the point of the court room and what everyone was trying to prove, it wasn't like there would be any thorough jail sentence or punishment, as they had to go back, so the whole thing with trying to prove or disprove facts was just a waste of time for what? Pride? A arrogant and egotistic battle on who's right and wrong? Cause that's what it sure as hell looks like, especially on everyone's "Is obvious I'm soooo right, and you're stupid" words throughout the whole thing. And they were all mixed up in this crap for no reason. She'd rather go back to darkness then be in this freaking damn hole, at least it was peaceful there.

    "For the fact that you need to be up there, Larxy, so we can continue to talk about your charges and perhaps drop them depending," Janexna answered calmly, kind of expecting this kind of retribution from her. She was thinking of addind if that wasn't what she wanted, but scratched it out due to the fact that she could predict Larxene will answer with a "I couldn't give a damn either way", or something along those lines. Still, she had to somehow convince her to come here, though the blonde female was a hard, hard case. "Listen, I'll give you my iPod to listen to so you can do something, and I promise you won't be questioned so much. All you have to do is sit there like you have done for the rest of this court session. You're being charged against crimes that aren't exactly that high on standard."

    Larxene giggled, this whole thing was hilarious. She placed a hand on her empty, noexistant heart of a chest, in a fake dramatic manner, looking sad and hopeless. "You don't say? Oh no, and what are they ever going to do to with littel ol' me? Take me into the electric chair? Hang me? Get a death sentence? Because trust me, after the first time, it goes along great, really, a true breeze. Oh! Or maybe go to jail for a whole year? Oh my God. The. Horror." She deadpanned the whole last sentence, giving Janexna a dry and unimpressed stare, while she was probably making a show in the middle of the room. Did she care though? The answer was obvious if you knew her well. She snorted arrogantly. "Face it. This whole thing is a ego clash between the prosecution and you, we're just along for the ride. But since you are at least on my side, I'll go and take a stand. Can't promise that I'll cooperate, though."

    She smiled a saccharine sweet smile there, ever so innocent, before heading to the defendant table in casual steps, passing through the swinging doors, and reaching the table, grabbing the iPod that was held out to her already. The thing was, she didn't really even know what kind of music was in there to match her taste.


    "Don't worry, I have I'm A B*tch by Alanis Morisette in there to fit your needs," Janexna remarked snidely as she saw Lar-Lar browsing through the selections. It was odd, standing so close to her favorite female character, though it was exciting at the same time. Yet, Larxene's aura also posessed a challenging tension that made her snap something back for...whatever reason she couldn't comprehend. She saw the blonde smirk at her with a raised eyebrow, not at all upset, but rather, interested.

    "Kind of catty, aren't you? I like that. Just make sure to watch your mouth around me next time, as...a freak accident might oh so happen to you, and you wouldn't want that, would you? I've been missing my toys," Larxene airily and lightly said as if she was talking about the sunny and warm weather, though a slight dangerous glint in her eyes proved that her threat wasn't one to be ignored. "So, do I go up or not?"

    Janexna kind of sweatdropped, a slight dab of fear running through her spine, after all, she wasn't a fighter, and well...this was Larxene. However, she shrugged in a relaxed demeanor, knowing Larxene doesn't attack unless the occasion called for her to have some fun. "It depends on what the judge decides, just wait a sec...I don't agree with the 'kids' going first, you call to the stand who you want to call to the stand...the order won't change anything."

    As a reply to that, she had to take out the papers she had on the side of the desk as Larxene went to sit on it, swinging her legs comfortably, placing on the earphones and pressing play to something she couldn't see, the female blocking it on purpose. And now that she looked at it, if you were none aware of her savagery, one look at Larxene, and you would think she was harmless, with the big aquatic eyes, pale skin, adorable voice, childish behavior (which was creepy or cute depending whether it's "I want to play with my toys! =3/>D" or "*pout*" ), and antennae strands sticking out like some innocent bug. Pfft. Talk about deceitful.

    Still, she entertained herself by trying to focus in the song Larxene was listening to to see if it carried through the air. Why was she hiding it?

    OOC: The only punishment I can see for Larxene that anyone would fear is having to spend the rest of her existence in solitary, chained to the wall, listening and watching High School Musical and its sequels in a continuous loop until she wishes that she could die, all the while going through Chinese water torture to prevent her from using her electricity TOO much. :p

    Pika_power stood back, watching the conversation between the defense and the witness. Eventually he grew bored, and asked "did you call her up here just to show contempt of court, or is she going to actually say something productive?"

    Pika_power then asked the Birdman "Is evidence different when given by the persecuted? Does she have to provide witnesses, or can she just say "I did not coerce Namine," and she can get off?"

    Harvey shook his head. "She cannot just say she did not do something and be acquitted of the charge. That is what the testimonies of the witnesses are for. If she lied she would be held in contempt of court. However, it is important to get the points of view of each person. I am actually surprised they called her before the others though as it would be more in their favor to let Larxene have actually heard the others first. This is how it works though and we just need to do our best to see her side and also relay the victims' sides as well to see her reactions which will help the Judge decide." Harvey whispered so as to keep his voice down while the Defense investigated their first client on the stand.
