    Birdman shook his head. "Again, if you have -no proof- to substantiate your claims you must drop them. Saying something 'matter-a-factedly is not proof. Just because DiZ could Dark Portal in the Castle does not mean a thing since he was an -outside force- and he was infiltrating the Castle Oblivion. He was NEVER held as a prisoner of the Organization during the time in question. Namine WAS by the account of Larxene, Marluxia and Vexen. Marluxia's statement is CLEAR that he had control over the Castle Oblivion AND the girl, Namine. If you have nothing to refute this I hereby stand that you must drop your claim that Namine was dubious in nature moreso than being a girl that was trapped, lonely and reached out on a thread to Sora, because she is Kairi's Nobody that had a connection to him. Proof, or you must back off this claim now. There is absolutely not a shred of evidence other than what you attempt to say as 'fact' which is just words with no bearing at all. Whether you have 'faith' to believe what you do, with no evidence, that is all it is and will not ever hold up in a court of law."

    He sipped at the coffee before him. "In other words, prove that Namine herself had the power to dark portal IN the Castle Oblivion while being under the control of Marluxia, and also prove why she would WANT to under the threat of being hunted down by not just Marluxia, but Xemnas, who passed the control of the Castle Oblivion to Marluxia AND the girl. This is the -law-. Not some fabricated self-belief. You cannot impose that for evidence. Without proof, nothing you say in this matter can be substantiated."

    Again, the lawyer thought to use personal belief to push an issue that was clearly a deception. This was growing old and only weakening the Organization's positions as far as Harvey was concerned. He began to wonder if this man kept tossing out such incredulous statements if any of the Org at all would be able to walk out with only minor charges.

    "In reality here, I am trying to assist that this trial gains a fairness and balance. Tossing off the blame of a coup onto a girl that did not even ponder it is weakening the case of Marluxia and Larxene and we refuse to toss out this information. There are others in the group such as Lexaeus, Zexion and Vexen that have charges but these are not quite so severe as that of Marluxia. You are trying to pass the buck off onto a girl with a 14 year old mentality that could not possibly have fathomed up this scheme and also playing light on the fact she WAS a prisoner. Whether she is a Nobody or not, whether she could sympathize with some of the members of the Org and the fact she wanted to also be 'real' is not a matter here. Of course she wanted what others did and it makes her loosely assigned to the group of the Organization. They ALL had a desire to be whole. She does not even once state the Nobodies do not have a reason for what they had done, though she also does not justify it. She was also NEVER a member of the Organization, but they held her because her POWERS were useful to them. Surely if this girl could have escaped and yet was held not even as a member of the Organization, why couldn't Zexion, Lexaeus and Vexen leave when Marluxia was first known to be a betrayer instead of bothering to face him?"

    "Now here's my point to you, sir. If the three with standings of being amongst the FIRST of the Organization could not leave due to fear of failure in the eyes of Xemnas, how is a little girl who is NOT a member of the Organization but is in fact just used for her abilities instead...she was never seen as a member and instead considered a weak witch with a link to Sora...how is this girl who was placed in the care of Marluxia going to just waltz out when she has LESS RIGHTS and privileges than the 3 members of the Org who were trapped with him? Those three have their own charges to contend with but you cannot toss out Marluxia's responsibility in all of this, nor the fact he held dominion over them all based on Xemnas's decision. Xemnas may or may not have known of Marluxia's own plans which would harm so many including his own people. I will wait to hear from Xemnas on this himself. However, there is NO WAY you can just cancel out Larxene's and ESPECIALLY not Marluxia's agendas from the court because it is this coup in the first place that not only endangered Sora and Riku and Namine, but also the fact it caused 3 Org members to die because they were not AS trapped as Namine and yet were nonetheless stuck because of fear of what Xemnas may do. The Nobodies DO have self-preservation, despite the lack of a Heart. Why did NO ONE leave until after Marluxia himself was contended with? Dark Portals or not, NONE of the Organization members departed. It is for this reason that I revoke your statements utterly as you have -no proof- whatsoever that Namine, who was held in a lesser position than all of the people there, could just take off at leisure while other Organization members would suffer and die and did not flee themselves. Drop this lie. It is an assumption and holding up the true justice of this case. We cannot dismiss allegations based on personal belief, regardless of how you twist things."

    Harvey was growing rather miffed that this man continued to try to do this. When was the judge going to call for order and dismiss this notion? He hoped soon because removing Marluxia and Larxene from charges with nothing was simply wrong.

    OOC: I agree. There's no way to prove this and hopefully we can move this on to something else. Although I did have fun arguing it out. Court battle drama amuses me for some reason. BTW no one answered me if I could have Zexion or not. *shakes a fist*

    OOC:Thanks for allowing me to be Zexion and lexeus,ICSP.

    Zexion sneaks in the door without being noticed.He had a night
    on the town last night and forgot to set the alarm.He didn't know what the hell was going
    on so decide to just nod as everything was said.He would speak when he knew exactly
    what was going on.As far as he could tell he had a lawyer and a cute secretary.He just
    starts reading the lexicon on law while listening to the court until he had enough info to
    actually say something.


    Lexeus had just come in after Zexion hoping that people would look
    at him as he came in and he'd sneak in unnoticed but that was not the case.He decides to
    Portal into his seat.He tries looking into Zexions lexicon because Zexion never wanted to
    share the knowledge within it , but Zexion kept pushing him in the opposite direction
    eventually pushing him off his seat.He then decided to just try and listen in on the
    court.

    OOC - For someone aspiring to be like Kristoph, Xelax is doing a fairly good job, just... well, Kristoph is a man for evidence. Now if he had picked a better role model, he might have noted something that would've helped him... Then again, I'm the judge, so... :P

    The judge frowned.

    "Mr. Xelax, I'm afraid Mr. Birdman is right. In a court of law, the only thing that matters... is evidence. Surely your mentor taught you at least that much. So far your drivel has been less than Phoenix Wright worthy. Even he manages to get evidence from somewhere. If you continue this line of thinking without presenting substantial proof of your claims, I'm going to have to penalize you."

    He then turned to the Pikachu.

    "My name is Erkz, after my father, who was also named after his father. I hope that satisfies you."

    "Now you're putting words in my mouth Mr. Birdman. I never said Namine plotted to overthrow the Organization, but rather, she plotted to mind control Sora. Marluxia just opportunistically expected Namine to have her help accomplish his plans. The truth is, Namine had a choice. She was not expected to do anything, unlike the other three Organization members who's dute was to stop the rebellion. Namine could have either have fled to Zexion and Lexaulus. Or she could have fled directly to Xemnas, who would have came down on Marluxia, not Namine."


    OOC: Sorry you had to find out like that Repliku, Daxma asked me via PM... and did a good audition for both characters.

    OOC: I posted that without reading the Judges request... let me bust out some evidence now...

    Zexion decides he should say something."I feel that all these allogations and objections about Namine are irrellevent.Namine is not on trial.According to law,no charges were pressed against her so,save the namine trial for another day ladies and Gentlemen".Zexion sits down and be's quiet.

    OOC: Yeah, well Kristoph got his butt wiped by a spiky-haired prick, a guy with demonic horns and some rocker with a funky hairdo that couldn't tell he was being manipulated. Actually, I kinda like the fact that Xelax is taking after Kristoph. It gives him a darker edge around his personality. ;)

    -EDIT- Zexion makes a good point. Namine is a WITNESS. She's not the DEFENDANT. :huh:

    The judge looked harshly at Zexion.

    "... You are out of turn, Mr. Defendant. Namine is a witness, and as such, will be treated as one. Speak out of turn again and you'll be held in contempt of court. I can assure you, you do not want that to happen."

    Naminé thought it was hilarious that Xelax was STILL trying to fight with meaningless conjectures. Right...Lexaeus and Zexion were down in the basement. She was all the way up on the thirteenth floor. That would mean she'd have to run down how many flights of steps? Considering she couldn't Dark Portal at the time (and the defense STILL hadn't proved she could) Naminé knew she would've gotten caught immediately.

    Seriously, this was getting ridiculous now. She figured that Xelax would try bringing up irrelevant evidence that had nothing to do with the charges at hand. She crossed her arms and waited. The guy didn't know when to admit he'd been beaten. There was also the fact that she was always being watched. When and how could she have escaped? Running could only take you so far...


    Kairi was getting a bit ticked now. This defense attorney was trying to fight dirty by deflecting blame onto Naminé. She glared at the judge. The defense's entire argument was irrelevant to Larxene. Why couldn't he see that?

    "The defenses claim that she had no reason not to use a dark portal other than the fact that Marluxia didn't let her is a lie. For there is a very good reason Namine refused to use a portal." Observe the evidence...

    13:35-13:40

    "You see there is a reason she refused to use a portal. Its quite taxing on someone's heart, or in this particular case, the soul. And a weakened soul might cause her to lose some of her focus on Sora. She did not want to squander her power by running, because that would loosen her grip on Sora!"
     
  13. OOC: You always refer to the judge as your Honor xP. It gets old, but you don't see any judge being called Steven.

    Xemnas sat calmly and nonchalantly in his chair, simply needing to sit through all the words and the exchange of contrasting views upon others. He didn't feel anything on the fact that his Organization, even himself, were on trial, and in truthful fact, he did not care, and was not nervous or anxious about the outcome of what it will be for him or anybody. He was seated in this court room, because he was simply there. Nothing more, nothing less. It wasn't like he had a heart to be fazed by the current events, though he did eye Larxene and Marluxia sharply as they walked away. Traitors. Along with Axel and Roxas in a later segment. He never did give them the rightful punishment in their place that they deserved, though he should've been more conscious of Axel further, as nobody had really bought his tale on what happened in Castle Oblivion. He knew well, that Zexion, Vexen, nor Lexaeus, faded by simple acts of the Keybearers. The thought was long ago, however, and the problem was far away, and now, here they stood. Being convicted on their acts for trying to gain back a heart.

    Janexna wanted to cry, that was barely even a break, and they were back all over again with the court, with a new (somewhat handsome) judge. Not only that, but Larxene, along with Marluxia, disappeared all of a sudden. Scratching her head a little as the discussion continued on, not able to reply back to Xelax's question in time, she felt something cold shudder down her spine, sensing something wrong near her. Naturally, she glanced over at her partner, almost suspiciously, not getting a good all around feeling with the aura he was possessing. Ignoring this for the moment, nonetheless, she made her way to stand up, looking straight at the judge, her iPod now put away. "Your Honor, I would like to tarnish this whole topic altogether, as it has fully drifted away from the main point of the prosecution concerning Larxene. What I have in mind, is to get back on that case, with the charges against her, and pick one to debate and discuss over until the next one chosen, while maybe calling a witness to the stand if need be to prove a point. I would also like to ask, that none of the prosecutors get close to me, Xelax, or my clients, as there could not be any antagonizing behavior when in court. Since the weapons charge was dropped, I would think, the next matter that I would like to consider for Larxene's charges would be theft, if that is possible, and if the rest agrees. Is all up to you, your Honor. Do we or do we not call Larxene to the stand?"

    Her small hairs were pricking at the back of her head, as Larxene hadn't returned, and she was hoping for a no. Damn it. Hurry up.


    "Shouldn't you be inside, considering you're the member on trial right this second?"

    "Bite me."

    "Think I'll pass," Marluxia countered in his ever deep, calm, and collected tone of a voice, arrogant, and yet exuding confidence. Not at all changed, and not expecting to, as he leaned his back in a wall, staring at nothing in particular.

    "Then get the hell out of my sight."

    He merely made a noise in his throat to himself in amusement when Larxene growled the words at him, her steel blue eyes boring into him sharply and with venom, to which he took without so much of a blink or irritation. He was too used to her mannerisms and behavior to be otherwise affected by it. They were now out in a elegantly shaped and decorated balcony, that rose above the view of the blue, clear sky and the small city below, the wind particularly breezy, but just the right temperature, and he heard the voices of the court from where he was in the distance. Sounding uninterested, he asked her blankly, "Is there something on your mind? I'm thinking this goes deeper than the Axel…double agent catastrophe?"

    "Since when do you give a damn?" Larxene questioned back disdainfully, already facing him as the wind blew her cloak sideways in a flutter, along with the loose strands of her silky hair, wondering what made Marluxia even ask at all, since it wasn't like him to. She didn't exactly wanted to share her thoughts on the whole matter of Castle Oblivion to him, after all, it was merely a partnership build on the same goal with mutual trust and respect, but nothing out of the ordinary for, what's the word...to care. Or maybe he was asking because it was to be expected in the situation. Larxene had come here for fresh air, but it seemed she wasn't getting the peace she sought after when Marluxia was here reminding her about it all, so this was all pointless. This definitely hadn't helped sooth her boiling anger, and crossing her arms in a sneer, she simply began to walk pass the pink haired man in a flurry, heading inside the hall reluctantly. "Either way, I'm not willing to tell you anything."

    "Suit yourself," Marluxia muttered under his breath as she left, not minding or troubled about her problems, and not concerned on hearing them. She was being difficult, as always, there was no point on progressing conversation any further, and he didn't want to. Larxene had this gift to keep a discussion going while throwing insults that flowed with it without anyone breaking away from topic, and that was something he didn't need to deal with right now. It was ironic, to think that the blonde was his partner in their goal on taking over the Organization back then, despite the fact that he was closely suspecting she had her own plans, if ever succeeded in reigning. Larxene wasn't a person or type to simply be second to anyone. And as proven, you could never be too careful in the game of disloyalty. Yet, even then, she doubted his idea on how to obtain the throne, not sure if it would work perfectly, knowing who they were dealing with. It seemed the case had more holes than he would've liked...

    OOC: You know, for once, I agree with Janexna. This whole thing is supposed to be about Larxene, but Xelax has deflected it WAY off topic. Seriously, I say a penalization for beating on a dead horse. Naminé isn't the defendant, Larxene is. All Naminé was supposed to do was testify about Larxene, but the entire shift of focus has been completely destroyed and off track. But Erkz is the judge...

    Kairi had a bit more respect for Janexna. At least someone on the defense actually had some common sense and wasn't afraid to use it. And of course it had to be the only woman in this courtroom. While the guys were trying to argue off the tracks, she managed to keep her focus despite not saying much about the case. Kairi rolled her eyes at the irony.

    The whole argument was wearing everyone's patience thin. Namine could sense it. Xelax had deflected the entire argument off topic and should be penalized for that. This was Larxene's trial, not hers. Namine questioned Xelax's strategy. He was obviously under the impression that his beliefs and irrelevant evidence would give him the boost he needed to win. However, in this case, the guy was just making a fool out of himself. How'd he become a defense attorney in the first place? He didn't seem to have a shred of honor or dignity. He had pride, she'd give him that much. But believing that you were right the entire time would limit your perspective from the truth. And in his blind arrogance to prove that he was better than logic and common sense, he had only crippled his case and let his defendants down in the process.

    She could only hope that the judge would see that...

    "Its still on topic," Xelax barked, banging his fist on the table. "How can someone really be coerced into something if the one being coerced was manipulating the situation. And at the same time, she had a way out the entire time."

    He then composed himself. Turning to his partner, Janexna, "Yeah your right, they do get in our faces, take our skittle and intimidate our clients. This should stop." As he looked into her eyes, he noticed she was distressed... he spoke really softly so only she could here, "Whats wrong?"

    Harvey shook his head. "There is no proof to your claims and I would appreciate if this was stricken from the records to press on. You are making assumptions and nothing more with no proof whatsoever."

    He turned to the judge. "Your honor, please can we move on as this is pertaining to Larxene's charges and Namine is hardly the only defendant here. This is wasting time and he is making the court more into a circus with trying to dazzle up words that are nothing but his personal opinions. He can in no way prove she was not a prisoner of Marluxia and it is already proven that Marluxia was both in charge of the Castle and her. We can therefore move past this so he can discontinue trying to remove charges of child abuse and assault on Namine as he has nothing to refute it at all. This dark portal theory does not hold up in any court of law."

    "A prisoner is a person who is confined to prison! Not someone whom has a back door to come and go as they please but chooses not to for thier own benefit.
     
  18. Janexna sighed, rolling her eyes slightly, though she got distracted when Xelax asked her what was wrong, and she smiled despite herself. Aw. So concerned. She was lucky to have a partner like him, ignoring the fact that he was so headstrong. "Nothing, just that Larxene and Marluxia aren't here in case she gets called, but it is not such a big deal, I'm sure she'll come soon. Though I would like to ask you to ignore Birdman and let the topic rest... we can discuss that type of situation when Marluxia is on trial instead of Larxene. It fits more to him than anyone else on the castle considering his position. You can argue about the whole matter again when the topic of Naminé appears." She eyed him thoroughly, almost in a stern countenance, though she elbowed him playfully. She had said her words in just as a whisper as he did, only for him to listen as well, yet she waited for his decision. "So, what do you say? Save it for later and get Larxene over with?"

    "I thought they were currently charging Larxene with coersion of Namine and Sora as well as child abuse. I haven't address child abuse yet, but coersion of Namine and Sora being charged against Larxene is heavily dependant on the arguement at hand." Xelax then looked around...

    "Where the hell are Larxen and Marluxia?" He scratched his head.

    OOC: Really, this is enough. This is holding everything up and there's nothing at all to validate Namine could just up and leave when she felt like it. *yyawwwwn* Can we please move on already? I wouldn't make a comment but others are and it's just become a redundant circle. Proving Namine did anything other than seek comfort because she was stuck at the castle is lame. It is clearly even said in notes about her in the journal, in the novel, and in the games. Refuting this is just making things bleah.

    Harvey shook his head. "You are going to drive this into the ground and yet have NO proof at all that the witness could leave of her own volition. You keep saying it repeatedly but it is nothing but speculation on your part. Stop holding up the court with an assumption. It is clear that Marluxia was in charge of her and the castle and that should end this. If she really could leave, why would she have brought Sora to a distant castle out in the middle of nowhere instead of LEAVING the castle because she was CLEARLY unhappy? She had no scheme other than what I mentioned prior of luring him there to give her some company of someone she knew even if she did not remember. That is ALL. Stop trying the witness! This is an outright deception."

    "Please, for the last time your Honor, dismiss this and don't ask for further proof because he has none. This has gone on long enough."
