No, but if there are no accusations for a day (as there was the first day), then Kira gets a free kill, ergo, one by the shinigami eyes.

 

Ok, but don't the rules say Kira has to get permission from the shinigami to use the eyes?

 

No, he gets to kill one person with them automatically if no accusations go by for a day. Ergo, Kira can now kill anyone he/she wants to.

 

I see, but thats not what the rules say. It may be best if Kira waits for HV to come back on.

 

Kira can still only kill when HV is on, so it doesn't really make a difference.

Accusation!

Fearless is bum rushed, blindfolded, gagged, and taken into custody for questioning. She is placed in a box and is forced to listen to Hanson until she is ready to talk. The next day they find Fearless crying and begging for the music to stop. She admits that she would like to use the Death Note, but only to kill the members of Hanson. She also consents to a search of her home. After a thurough search nothing turns up and sheis released due to lack of evidence with a severe headache.
