OOC: I would say that it is Xemnas's rights if he wants to drop the charges he can and the prosecution could be **** and keep them but at the same time, it would be harder to keep them because Xemnas doesn't want them which is why Harvey is asking Xemnas direct. OOC: Also, in seriousness, child abuse is one charge. Aggravated Assault definitely stands out as its own. Child abuse can mean pinching a kid too much, neglect, etc. It is a charge separate. =:/ "I do not believe we should try to charge her with a crime if Xemnas himself isn't going to follow through that he wishes the Organization members defended against acts of other Organization members. That is his right to say as leader of them. We could try but I think it would be a waste of time. The Defense can keep on saying 'but the leader doesn't wish this charge so why should you condemn the individual to death now that the whole thing is over?' thing repeatedly and it is a fact to contest against." "The theft charge changing is fine with me as well. As for Axel's situation, that will depend on what the witnesses say about him then and there, to include Roxas as well as the other 3 kids. In the end, I'd just say we use Xemnas's rule in regards and he cannot really set it for -one- Organization member and not all of the others who did things, so let's hear out his response first and decide from there. If he says no, though, I'd advice against trying to fight for charging any members with crimes against the Organization as it is kind of his right to do so."
OOC: Okay there are a couple of issues to raise here. Why are people now saying that if someone goes down that he is just KO'd until a potion is dropped? If Sora LOST the fight all the way with Donald and Mickey they are considered DEAD. The game is over. Also, Larxene -did- intend to kill him. The whole point of the game change shift was that Larxene and Marluxia tried to kill Sora and Zexion was out to murder Riku. Can we please stop trying to add things to the Defense that are like "He'd never go and die because in the game mechanics it can't happen unless he loses utterly" please? That is not evidence to support anything. It's the second weird charge thing contested because of how the game runs which is kind of a kid's game in the first place so of course if Sora 'dies' we just get the screen of him floating. IC: "Pika, we do not need to bring Roxas up there to go against Larxene as he didn't even know her, most likely. You have two other witnesses to call or one of the Org who knew her and what is the point? Let's wrap it up so we can negotiate the terms of lowering some charges with the Defense if we are going to and Larxene can be done. The theft is not that important and would be dropped in negotiation anyway. Let's not hammer away at something that is a petty thing and since the defendant here is just wanting it over, we can go in the back and talk to the Defense and negotiate final charges with the Judge and be done. He just needs to state which charges stand and which won't to be negotiated." Harvey sighed and addressed the court. This was going nuts and the charges were very clear to him. "Child abuse is to mark the point that they were -kids- who were attacked, taunted, neglected and mistreated. Child Abuse holds for all three cases due to the fact that they encompass more than physical abuse. They are separate charges from Aggravated Assault charges which were wounding someone of any age physically in an assault and battery type way. They stand separate even though they coincide and support one another. They should stand. I am seriously not thinking I need to go down the list and prove each count once again. As for the theft, if Pika Power would agree, that charge can be removed as it is a petty crime in light of all else going on." "The murder attempt should also be present as the Defendant clearly said those words and this is a time in the actual events when Larxene sought to murder Sora clearly and Zexion also attempted to murder Riku. This is plainly clear in the evidence." "As for dropping the Coercion attack on Repliku, I do not see how it can be removed when he was attacked against -HIS- will and this is not just telling a kid to go and do something because daddy said so. This is mind raping him. You are clearing the very fact that she forced this boy to be mind raped, pure and simple. That is coercion. Technically it could be a worse charge whether a parent clears it or not. I was going LIGHT on this." He turned to Pika Power again after addressing the court and said softly... "Also, as I said, I'm willing to go with what Xemnas wants if he does not wish to press charges because at the time and place Xemnas was in charge of them. They are like their own nation/city state in that regard. His own judicial system would have been adhered to which was 'death' if we were to decide to follow his stricture guided at the time. I do not see why the defendant should have a sentence carried out so strictly if now at this time, Xemnas would not opt for his own judicial law to be carried out. Betrayal and attempted murder of a person in a society usually merits something very harsh as a punishment whether life in prison or whether it be death. Are you saying you want to keep tacking these on when clearly it means the doom of her, when she could be, as other Organization members could be, rehabilitated, understood and possibly assisted to exist at all? Her crimes are severe, but there are people with worse scenarios and if we add it here to Larxene's, we also add it to Axel's, Marluxia's and Roxas's, which Axel and Roxas are two members that turned things around and Marluxia will already have a ton of other charges against him as well." "So in simple, Pika Power, are we truly out to just kill off the Organization, marking all members as non-repairable for crimes against themselves when they all possibly had reasons to do these things? My angle on this was to get them charged with what they actually did to others outside of the Organization because it is clear that these are the charges that affected others and worlds and infighting between themselves, they knew the penalties from Xemnas. Most of them -died- any way because of their stances against others of their own ilk that put them in positions to do what they had. Especially at Castle Oblivion if you think about it. If the Organization members had not been fighting over power and control, to push things, they would have not died there, manipulated Sora, Riku and Namine there, etc. This is why I don't wish to include the charges if Xemnas does not." Harvey looked over at Xemnas. "I must ask you sir, for a straight out answer so that we do know what direction to go in now. Since you are present, and I do not wish to just go by papers, do you wish charges against your members who betrayed you to be permitted into the court rulings or do you wish them to be removed?"
Harvey shook his head. "Sora was attacked when Larxene was saying 'she's the bad guy' and she kicked him knocking him back several feet with no provocation. He had not attacked her at the time. This is the moment I speak of. That is aggravated assault and/or assault. It stands." "She cannot get off on just a physical abuse charge for Namine either. She slapped Namine very hard to the side and that is by all accounts Assault." "Tossing Repliku to the side, whether he's not 'operating' as you all want to say or was is not important. You don't throw a person several feet to the side and their body collapses to the ground if they are having a stroke. That would be seen as utterly cruel and I am not sure how it is avoided in this matter. He -is- a living being, whether people still want to call him a 'doll' or not. What Namine did to him does not remove his -sentience- at the time. He would be considered to be in a comatose state. No one would go to throwing someone who is in a coma around and not be charged. He was incapacitated and helpless and she tossed him -like- a rag doll. This charge stands of Aggravated Assault. He could in no way defend himself." "As for Xemnas's right to drop charges against Larxene for the planned death of Vexen and also her betrayal charges or anything connected on that front, Xemnas has the right as he was the official authority in charge to administer 'justice' to the Organization members under his leadership. It will be honored." "As for Repliku's scenario of dealing with being told he is forced to have his memory wiped, reacting and Larxene hitting him, that charge still stands as he was a minor that was being forced to have his very mind altered and it is SHE who took him after to Namine as well. I can imagine he did not just go 'peacefully' by the very end scene where he is crying out against it extremely dramatically. She forcefully took him against his will after hitting him far harder than necessary in the similar manner she did to Sora who was just standing there. The charge of Aggravated Assault remains." "Therefore the charges are as follows that will stick and need to be confirmed and not continued to be argued upon any further." 3 Charges of Aggravated Assault (Sora, Namine and Repliku) 1 Attempted Murder (Sora) 3 Counts of Child Abuse (Sora, Namine, Repliku) 3 Counts of Coercion (Sora, Namine, Repliku) 1 Count of Theft. (Sora) "Please, your Honor, can these charges be finalized so that we can move on? Xelax can continue to debate but he is going in circles and none of these counts will even merit Larxene to have the death penalty as the most severe charges were removed by Xemnas and his penalty would have been outright death for betrayal at all in the first place. The theft is also not such a grand thing and we could part with that charge as it is a petty crime and he did in the end have it recovered to him. The other charges are fair and balanced and we don't need to continue the circus that keeps being incited by trying to disprove what has already more than been made clear." He gave a look at Pika Power as well. "Can you please go along with the charges here and not add anymore or alter it? If you need to alter it, let's talk but I do not think any other charges are going to stick as there is not enough viable proof."
Lack of petrol, in itself doesn't bug me as anyone who's kept up with the times knows that sooner or later we are going to run out. Oil companies have to use all sorts of methods now to find oil whereas in the past it was a lot easier to locate and now drilling has had to also become a lot more specific to regions. Oil companies though are going to want to run us out of oil before they stop cashing in on it and don't adapt and don't seem to want us to either. There are all sorts of nasty ways oil companies keep us dumb and dependent on it. In a way, I will be happy when we are no longer ran by oil companies and am glad to see that bit by bit we are coming to have other means to get around such as hydrogen cars etc which will be better for the environment. Losing petrol cars would make it so that carbon dioxide levels drop considerably around the world too and help our environment from those melting ice caps and the Greenhouse Effect. In the long run, even if things cost a fortune now for alternative travel methods than petrol ran cars, it will also be cheaper. I just filled up my gas tank and it was 60 bucks and I'm not an owner of an SUV or some crap. It's simply ridiculous to be stuck like this with no alternatives. I do hope that people such as electric companies etc will go ahead and start learning to switch to alternative methods such as wind fans and solar power because we do need to lower the carbon dioxide and also it's cleaner energy. Unfortunately, I hear a lot of older people gripe about wind fans complaining about noise and they are 'unsightly' and all. They aren't helping the problem and they are supporting keeping petrol around as our major power source and I don't think wind fans are ugly at all. I plan when I get out of college to get some on my property when I get a house and neighbors that gripe about it can whine when they run out of petrol services in 20 years. BTW, great topic. I do agree it does make us do more physical activities too. 60 bucks for filling the car and also a larger than I want electric bill certainly do make me think of alternative methods of travel to preserve the gas more. I can't say it's been unhealthy to me at all. However, I am still dependent on that vehicle to do things as others mentioned, such as shopping for food. It's really the poor people to lower middle class that are stuck with less options as getting other methods of transportation is extremely costly in comparison. We also have the largest population so those methods need to come down in price so we could do the switch and all.
Girls get to physical maturity faster than boys by nature. Girls are done growing by the time they are 16 on average to 18 years old. Boys are finished growing usually by the time they are 18-19, sometimes at 21. Note here there are 2 years difference around in most cases. However, I do not know if I agree they 'mentally' mature faster than boys as a rule. I'd think more it depends on the individual kid. Males and females as children require play just as animals do to get prepared and hone their skills at young ages. I don't think a doll given to a girl means that the girl is going to be more mature than a boy mentally who goes outside and plays sports instead or plays with action figures, but their development will instead mature in areas specifically instead of having a range of knowledge. Also, when growing up, boys around girls sometimes play 'house' as I did because I had a few friends that were girls as well as hanging out with boys when young (around 4 to 6). It's not that uncommon and a good thing for boys to have that too, though getting a boy to sit through it later than 6 is probably asking a lot. Playing with baby dolls can teach a girl or boy some sensitivity and preparation for child rearing but that is not all that there is to growing up that is important. However, I think that girls who actually do other things too, like sports, using their imaginations and using action figures etc develop probably more than just girls with 'stereotypical' female toys. At least they seem more mature because they are more friendly and outgoing and learn other skills as well as the typical 'mommy' ones and can deal with boys better. I think playing 'house' growing up probably gave me a better understanding of females too. So in the end, I think integration at a young age for boys and girls helps both develop better than just segregating kids as some parents do when they are at the most important times of their lives soaking in information like a sponge as they play. Kids that have no interactions with doing a variety of activities amongst both genders at 3-6 seem to be the ones who develop more slowly in mental maturity, I think. I don't have anything really to base on it but life experiences and seeing kids mature into adults and how they turned out but it seems to hold true in most cases.
Harvey frowned. "Alright, so then the total charges for Larxene would be... 3 Charges of Aggravated Assault (Sora, Namine and Repliku) 1 Attempted Murder (Sora) 1 Premeditated Attempted Murder (Xemnas + those sympathetic to Xemnas and not Marluxia) 1 Murder - by association - (Vexen) 3 Counts of Child Abuse 3 Counts of Coercion (Sora, Namine, Repliku) 1 Count of Theft. (Sora) "These are just as they stand and can be negotiated as to severity and some may be worked on to be eliminated off. We just need to know what the Defendant wishes to do and her lawyers. Pika Power and I just need to know then if Larxene is going to keep her stance for sure. Then we can work on what we feel can be dropped or remain, lessened, etcetera." Harvey was a bit confused right now and just needed things to be straight now so that one case was over. Marluxia's scenario was worse by far and he imagined the charges on murder issues related to the Org members themselves probably would be auto-dropped, making Larxene's case not really meriting death at all. It was Marluxia that was going to probably be charged heavier because he was the leader. Sora sat up now intrigued. He could actually get why Larxene just wanted her trial over. It did seem kind of boring in a way to sit up there like that. But at the same time it seemed exciting too. The whole case was odd because where was the 'law' while these people were running a muck with no one at all there to put them in line? Seemed kind of odd to have a trial after all the facts happened, but in a way if it meant to make things clear and allow some people who may have been misunderstood to have a chance...he supposed that might be why. Because the Organization had gone about things so wrong, maybe this was to see if they could do things right. He supposed that was fair. Riku looked at Larxene and shook his head. She was pretty but also such a B. He wasn't sure if in normal circumstances he'd think she was kind of cool or not. After all, a girl that could kick ass and look good, have an attitude, that was kind of awesome. But she was also sadistic and liked to strike out at people. He did wonder if she would have been different if not encouraged by Marluxia or whoever, but it was not something to ever figure out. In a way he was kind of glad if she was done with her case. She kind of reminded him of how Axel had been...doing things so spontaneously, being intelligent but looking so hot headed. Riku had not minded Axel and even sympathized with him, which is why he didn't kick Axel's ass when he went to go kidnap Kairi, and instead just took Kairi elsewhere. He felt bad for the guy but could not let him make Sora into a Heartless again. He did see how Axel turned things around though for friendship and maybe Larxene could too. She was a tough egg to crack though.
Roxas looks just like Ven in BBS. So we do not know if he 'aged' at all while being separated from Sora. Also, I can think of an excuse even if Namine and Roxas -did- age and the other Nobodies didn't, which would be they had 'real' selves too, so it could affect them. I do think though that in BBS, Ven is actually 15.
OOC: Can the Judge also answer the question Harvey asked about Organization crimes against Organization members? It's kind of pertinent to the whole outline of the case for the Defense and Offense.
The game really looks great and I liked the other GTAs a lot so I will be getting it. I would have gotten it whether it had been rated lower or not. It's nice to see though it did get a great rating from so many places and not just a couple. So far, I've heard of some small setbacks to the game but nothing that seems to take away from the story or the activities in it drastically so definitely it's on my list of wanted games.
Yeah, that's my curiosity too. Her daughter goes missing...years later she's ending up with 'stray kids' to adopt and raise. There's just something that would cross my mind as odd. Also, the kids would have to look like the daughter to some degree and/or the father. Adopted kids don't do that. It just seems hard to not be curious at all to the state of things. The man was clearly sick. If he's not killed, he better surely be placed away for life. That way he can never do this sort of thing again.
Harvey frowned a bit at the Pokemon's response. Maybe he was more of a defense attorney than prosecution in this matter. He did not see a reason to say out a sentence of life imprisonment as a joke or to make things more difficult. This is what negotiation was for and he may have to argue if Larxene did in fact plan on admitting guilt to the counts. He may deal with Jan though as he did not really hold any amount of respect for the other lawyer either at this point. Then again, Pika and Xelax did in some ways balance each other out well. He wanted to say something to Pika but decided he had hurt the Pokemon already enough and it would be someone else's call if they were going to. His eyes however did go wide when he made the comment of putting her in a cell with Axel. He was sure that would go over well. *note sarcasm here* He cleared his throat once Pika Power was done speaking. "The charges are as follows, Larxene, so you know for sure since some were missing." 3 Charges of Aggravated Assault (Sora, Namine and Repliku) 1 Attempted Murder (Sora) 3 Counts of Child Abuse 3 Counts of Coercion (Sora, Namine, Repliku) 1 Count of Theft. (Sora) "The following cannot be counted in the charges unless the Judge agrees to it." "Attempted Murder of Xemnas, and the Conspiracy against the Organization itself." If this charge were to remain we could also put in there the fact that she and Marluxia were 'testing' Axel's loyalty by having him kill Vexen after labeling Vexen a traitor. I need to know before we continue if charges against Organization members for crimes against Organization members will even be permitted as something 'chargeable' and if so, to what extent. Your Honor, if this is so, I will amend the charges to add these two, but at this time they should not be added due to the fact Xemnas was the leader of the Organization and therefore at the time of this all, he would have been the one to determine punishments for betrayal, abuse of power beyond what he wished and so forth." He looked at Larxene. "Those are the charges as they stand at the moment." He decided to be upfront with her and looked over at Janexna to see her response and if it sounded reasonable. None of these charges merited the death penalty or life in prison without parole, certainly. If all was agreed to, he knew what charges to drop to give her some less prison time, but now it was in their court to decide what they would do. In a way he hoped Larxene would just keep with her stance so that they could move it on. She was hardly one of the more difficult people to be charged that actually -could- face life imprisonment easily and/or the death penalty.
Repliku stood up and pointed at Larxene. "You are going to sit there and take this crap whether you like it or not. You can't just get out of this by deciding you just don't care. It's your stupid life and though I doubt you'd actually get the death penalty for what you did, you can take ONE THING SERIOUSLY in your existence and SIT THROUGH IT!!!" Repliku glared really cold and his hands were once again emitting dark tendrils of energy like flames. "You are a very mean person but there is more to you, Larxene and maybe if you'd just sit there and SHUT UP for once, because we all know how much you love the sound of your own voice, it might HELP YOU. Don't you get it that they are trying to find anything at all WORTH you living that is inside you? Are you really just a nothing blabbermouth that bullies people all the time, treats people like crap, makes people feel miserable? Do you HAVE another side of you? Why can't you even show it? It is this very attitude that made anyone around you not know what to do with you. Just stop it and LISTEN and find SOMETHING about yourself. You can call me a stupid doll all you want, but you are totally being so much more of a NOTHING than I could ever be. I was made, but so were you. Get over yourself." Repliku shook his head and sat down furious. Harvey sighed. "Larxene, you can admit to the charges and at the end they will be dropped or adjusted. I do not believe I have to counter anymore of the Defendant Lawyers' claims because they are hypothetical and unfounded and what was said stands as enough proof. I am willing to let you come down from the stand if the others are. Tell us what you want." Harvey Birdman rubbed his temples. This really was going to be a long day. Larxene probably was one of the ones of the Organization that would come off not so badly. He awaited her choice before deciding whether to go with the rebuttal he had to the Defense lawyers.
Harvey glanced over at Axel who was eying the poor Pokemon. He then followed the gaze direct as these little yellow lines appeared in his mind between Axel's eyes to their location and saw they went right to the Gameboy as it was in the Pokemon's hand. Another analysis popped up as he studied Axel's expression and his eyes went to the floor since the Gameboy fell. "I think he either wants the Gameboy or he likes your feet. One of those two options."
Yeah, so far they are only rumors. Many of us were leaning on that to hope this would happen because there were other sources too that spoke of it. However, if they were going to do it, they should make it in the year or two because otherwise it will just be too late. =:/ At this point I think most of us have just accepted it isn't happening so people have either written the games off or gone and gotten the Japanese version.
OOC: Mebbe it was a dare... Yeah though, you are right, no one put Repliku with charges so technically he's just a witness. So he's not sitting with the Organization really. He hasn't been sitting by the 'heroes' exactly either, kind of more to the middle or back having fun fuming on his own. He doesn't know if he -wants- to sit by any of them because he doesn't know how they feel about him or he feels about them. He has issues!
*laughs* That killed me. Do you think 'Xehanort' in KH games is either Terra or the Apprentice of Master Xehanort?
---OOC---- Repliku sits wherever he wants to. I don't even know where he's sitting. lol. But tell him he CAN'T sit somewhere. I dares you! OOC: I did read them. I never noticed you edited and all. Sorry about that Pika. But really in the end it totally flows in with what Harvey said too. so it works out. No worries. We did get to moving a lot faster. Harvey pats Pika on the shoulder. "You are doing great and no, I only felt the need to retract your first questions and statements. Do you see why now? I hope you do. It's not like I want to steal your show away or anything. You did great with this now and no, we aren't ignoring you." Harvey pulls out a bag of Skittles. "Here. Hope this cheers you up. You deserve it."
OOC: Get ready for another 11 pages on Larxene. lol -Also, I do know what each charge is I added lol. I thought it funny ICSP that you tried to get me to drop a charge by playing my knowledge on it. That was a good one. =:) I was actually pondering becoming a lawyer at one time and took some law classes. I decided to go for something else cuz well...no one likes lawyers even if Harvey cries to me when I say that. -Sorry, Pika, had to answer the 'Objection' or you were next but in the end it works out that both spoke out any way. You presented a side that Harvey did not and vice versa. It works out. Last thing, I think that some penalties are attached to the different Org members for the same incidences because they were there or in on it, but for the most part I do think it makes it interesting that each Org member has to be proven to have the charge as stated, rather than just saying because 'larxene is charged with this, Marluxia gets it with no chance for rebuttal'. It does make the rpg more interesting as Erkz said. Sora watched the case now just playing tennis as he went from lawyer to lawyer. This case had only just begun and yet it felt like it had been going on for hours...had it? Ah well. This was one heck of a fight. "That's what aggravated means?" Sora needed to really pay more attention to school. Repliku was ready to go over and rip that lawyer's head off about now. Prove he was sentient..."grrr" was all he could muster to keep himself quiet and in his seat. In his mind he could hear Gollum. oO(We hates dem all)Oo It voiced his sentiments exactly about Larxene and the lawyer at least. Riku was just shaking his head. He looked over at Repliku who's fists were now dancing black energy around like wisps of smoke. How much longer he could contain it was a matter of opinion at this point. "...It's going to be okay. Don't let this get to you too much. This is just how these things work. It's annoying and makes anyone get angry to be talked about bad, but it's a necessity. It will work out." Repliku scowled at Riku. He wasn't sure he was mad at Riku for the right reasons at this point. "You be called a fake repeatedly, a DOLL and tell me that you'd stand for it. No one else would. They got all over Pika for saying that thing about Nobodies but yet I'm supposed to hear this crap about me?? It's Reaaaaaaaally making me very angry. At least I'll have the last laugh and say they died by a doll." -.- "They don't know what they are saying. You are as real as you want to be, just like anyone else. People can be really fake sometimes or very true to their beings. You be true and real and let them talk what they want. It'll all work out." Sora gave a light smile to try to help cheer up the other Riku which now he could tell the difference between the two much more easily because his friend Riku was older and taller now with longer hair now. Maybe that might comfort Repliku some too if he noticed. They had some noticeable difference to see. "Grr...fine. I swear though if he keeps saying it I'm going to show him how -real- I am." Repliku's Darkness went down as he tried to swallow the rage and cool off.
OOC: yeah this is going to be long but it is entertaining. In the end, I don't get how we are fighting over what the game itself says about Namine as well as the novels. Let alone the other Nobodies. I'd hate to have to go through and post a ton more stuff from KH2 etc to show this stuff. lol. I've been absolutely taking things straight from the games. Also, where does this become just about Namine? I am very confused how charges were not established for Sora and Repliku pertaining to Larxene and so they would feasibly realistically be there. The case is totally unfair and biased without them.
Harvey smirked. "I had already said she had memes and a Soul as ALL Nobodies do. It seems prevalent to reveal itself with some more than others, but ALL of them have souls and therefore conscience. If they choose to ignore that, it is on them. If they do not, then it is as it is, no remorse, no regret, no change and it is nothing different from a pathological serial killer. Namine -did- in fact listen to her Soul. And what I said last time as she is an unusual Nobody is substantial enough to say so, as was Roxas. Even Axel developed a conscience. If you continue to say Namine did not have memes and a Soul then we might as well just call this at an end and say ALL Nobodies are non-redeemable and threats to society and existence and will just do their plans again that harmed many people." "As for Repliku and his sentience, Here you go." "Now let's look at this. First off, taking aside the facts a boy is told he is a 'fake' with a body and heart that is 'fake' it is obvious he cannot be. He should be an empty shell because of what Namine did to him, but instead his Heart managed to retain his integrity. He pulled himself together by his very will, overcoming what should have been technical brain death in some manner, using the only thing he had to do so, which was a promise." "So, while this promise was fake in itself and he acknowledges it as a phantom promise or not, he had a will, a soul and heart of his own. He defied the very foundations of being a doll or toy. This sentience is proven by this. Now prove he's NOT sentient by some show from the boy himself and not just Larxene's and Marluxia's words."
